8 Committee Note:
9 The Executive Appropriations Committee recommended this bill.
10 General Description:
11 This bill supplements or reduces appropriations previously provided for the use and
12 operation of state government for the fiscal year beginning July 1, 2016 and ending June 30, 2017.
13 Highlighted Provisions:
14 This bill:
15 ▸ provides appropriations for the use and support of higher education and certain state
16 agencies;
17 ▸ provides appropriations for other purposes as described; and
18 ▸ provides intent language.
19 Money Appropriated in this Bill:
20 This bill appropriates $211,182,600 in operating and capital budgets for fiscal year 2017,
21 including:
22 ▸ ($3,984,700) from the General Fund;
23 ▸ $215,167,300 from various sources as detailed in this bill.
24 This bill appropriates ($3,144,400) in expendable funds and accounts for fiscal year 2017.
25 This bill appropriates $46,682,500 in capital project funds for fiscal year 2017.
26 Other Special Clauses:
27 This bill takes effect immediately.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. FY 2017 Appropriations. The following sums of money are appropriated for the
33 fiscal year beginning July 1, 2016 and ending June 30, 2017. These are additions to amounts
34 previously appropriated for fiscal year 2017.
35 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
36 Utah Code Title 63J, the Legislature appropriates the following sums of money from the funds or
37 fund accounts indicated for the use and support of the government of the State of Utah.

54 intends that appropriations up to $300,000 provided for the
55 Governor's Office - Constitutional Defense Council in Item 27

57 Fiscal Year 2017. The use of any funds is limited to one-time
58 expenditures related to the Constitutional Defense Council.

64 Fiscal Year 2017. The use of any funds is limited to grants
65 awarded by the Commission on Civic and Character Education.

68 intends that appropriations provided for the Commission on
69 Criminal and Juvenile Justice Indigent Defense Commission
70 in Chapter 177 Laws of Utah 2016 not lapse at the close of
71 Fiscal Year 2017. Indigent Defense Appropriations are
72 non-lapsing under 77-32-805 (2) (b).

To Governor's Office - Commission on Criminal and Juvenile108 Justice
109 Under Section 63J-1-603 of the Utah Code, the Legislature
110 intends that appropriations of up to $2,422,000 provided for the
111 Commission on Criminal and Juvenile Justice in item 13 of
112 Chapter 4 Laws of Utah 2016 not lapse at the close of Fiscal
113 Year 2017. These funds will be limited to employee
114 incentives, one-time remodeling costs, equipment purchases,
115 one-time DTS projects, research and development contracts,
116 extradition costs, meeting and travel costs, state pass through
117 grant programs.

To Governor's Office - CCJJ Factual Innocence Payments119 Under Section 63J-1-603 of the Utah Code, the Legislature
120 intends that appropriations provided for the Commission on
121 Criminal and Juvenile Justice - Factual Innocence payments in
122 Item 14 of Chapter 4 Laws of Utah 2016 not lapse at the close
123 of Fiscal Year 2017. Factual Innocence are non-lapsing under
124 78B-9-405 (2) (b), and may only be used for court ordered and
125 legislatively appropriated factual Innocence payments.
