7     LONG TITLE
8     General Description:
9          This bill permits a student to carry and use sunscreen at a public school.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines sunscreen;
13          ▸     requires a public school to permit a student to possess and use sunscreen at school;
14          ▸     permits a school employee to apply sunscreen on a student under certain conditions;
15     and
16          ▸     provides immunity for an employee who applies sunscreen on a student and
17     provides immunity for the employee's employer.

26     Be it enacted by the Legislature of the state of Utah:
27          Section 1. Section 53A-11-606 is enacted to read:
28          53A-11-606. Sunscreen -- Possession -- Self-administration.
29          (1) As used in this section, "sunscreen" means a compound topically applied to prevent
30     sunburn.
31          (2) A public school shall permit a student, without a parent or physician's
32     authorization, to possess or self-apply sunscreen that is regulated by the Food and Drug
33     Administration.
34          (3) If a student is unable to self-apply sunscreen, a volunteer school employee may
35     apply the sunscreen on the student if the student's parent or legal guardian provides written
36     consent for the assistance.
37          (4) A volunteer school employee who applies sunscreen on a student in compliance
38     with Subsection (3) and the volunteer school employee's employer are not liable for:
39          (a) an adverse reaction suffered by the student as a result of having the sunscreen
40     applied; or
41          (b) discontinuing the application of the sunscreen at any time.
