7     LONG TITLE
8     General Description:
9          This bill enacts provisions related to the employment of licensed athletic trainers in
10     public high schools.
11     Highlighted Provisions:
12          This bill:
13          ▸     requires a local school board or charter school governing board to employ a licensed
14     athletic trainer at each public high school that has an athletic team; and
15          ▸     enacts provisions related to the employment of a licensed athletic trainer at a public
16     high school.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 53A-3-433 is enacted to read:
27          53A-3-433. Athletic trainers in high schools.

28          (1) As used in this section:
29          (a) "Athletic contest" means a contest between two or more athletic teams from
30     different high schools.
31          (b) "Athletic team" means a high school athletic team that participates in a sport as a
32     school-sponsored extracurricular activity.
33          (c) "Athletic trainer" means the same as that term is defined in Section 58-40a-102.
34          (2) (a) In accordance with Subsection (2)(b), a local school board or charter school
35     governing board shall employ an athletic trainer at each public high school that has an athletic
36     team.
37          (b) If the employment of an athletic trainer described in Subsection (2)(a) requires a
38     local school board or charter school governing board to create a new staff position at a high
39     school:
40          (i) the local school board or charter school governing board shall, to compensate the
41     athletic trainer in the new staff position, use funds that are available due to the departure of an
42     employee of the school at which the athletic trainer will be employed; and
43          (ii) the local school board or charter school governing board is not required to comply
44     with Subsection (2)(a) until the later of the beginning of the 2020-2021 school year or the day
45     on which funds described in Subsection (2)(b)(i) become available.
46          (3) A high school at which an athletic trainer is employed shall ensure that the athletic
47     trainer is present on the school's premises and available to assess athletic injuries at all times
48     during which an athletic contest takes place on the school's premises.
