7     LONG TITLE
8     General Description:
9           This bill addresses funding for Antelope Island State Park.
10     Highlighted Provisions:
11          This bill:
12          ▸      creates the Antelope Island State Park Improvement restricted account;
13          ▸     states that proceeds from a big game hunting permit or tag distributed for a hunt on
14     Antelope Island shall be deposited into the Antelope Island State Park Improvement
15     restricted account;
16          ▸     directs money from the purchase, trade, sale, or disposal of buffalo on Antelope
17     Island to the Antelope Island State Park Improvement restricted account; and
18          ▸     makes technical changes.

31     Be it enacted by the Legislature of the state of Utah:
32          Section 1. Section 23-19-22 is amended to read:
33          23-19-22. Big game hunting permit.
34          (1) A person who is at least 12 years old, upon paying the big game hunting permit fee
35     established by the Wildlife Board, paying the fee established by Subsection (4), and possessing
36     a valid hunting or combination license, may apply for or obtain a permit to hunt big game as
37     provided by rules and proclamations of the Wildlife Board.
38          (2) (a) A person who is 11 years old may apply for or obtain a big game hunting permit
39     consistent with the requirements of Subsection (1) if that person's 12th birthday falls within the
40     calendar year for which the permit is issued.
41          (b) A person may not use a permit to hunt big game before the person's 12th birthday.
42          (3) One dollar of each big game permit fee collected from a resident shall be used for
43     the hunter education program as provided in Section 23-19-17.
44          (4) There is established a fee in the amount of $5 added to each permit under this
45     section to be deposited in the Predator Control Restricted Account.
46          (5) The division and the Division of State Parks and Recreation shall ensure that the
47     proceeds from a big game hunting permit or tag distributed for a hunt on Antelope Island be
48     deposited in the Antelope Island State Park Improvement restricted account created in Section
49     79-4-1002.
50          Section 2. Section 79-4-402 is amended to read:
51          79-4-402. State Park Fees Restricted Account.
52          (1) There is created within the General Fund a restricted account known as the State
53     Park Fees Restricted Account.
54          (2) (a) Except as provided in Subsection (2)(b), the account shall consist of revenue
55     from:
56          (i) all charges allowed under Section 79-4-203;
57          (ii) proceeds from the sale or disposal of buffalo under Subsection
58     79-4-1001(2)[(b)](c); and

59          (iii) civil damages collected under Section 76-6-206.2.
60          (b) The account shall not include revenue the division receives under Section 79-4-403
61     and Subsection 79-4-1001(2)(a) or (b).
62          (3) The division shall use funds in this account for the purposes described in Section
63     79-4-203.
64          Section 3. Section 79-4-1001 is amended to read:
65          79-4-1001. Purchase, trade, sale, or disposal of buffalo -- Proceeds.
66          (1) In accordance with a plan, approved by the board, to manage buffalo herds on
67     Antelope Island, the division may purchase, trade, sell, or dispose of buffalo obtained from
68     Antelope Island through:
69          (a) competitive bidding; or
70          (b) a means as established by rule.
71          (2) Proceeds received from the sale or disposal of buffalo under this section shall be
72     deposited as follows:
73          (a) the first $75,000 shall accrue to the division for the management of Antelope Island
74     buffalo herds as dedicated credits; and
75          (b) proceeds in excess of $75,000 shall be deposited in the [State Park Fees Restricted
76     Account created under Section 79-4-402] Antelope Island State Park Improvement restricted
77     account created under Section 79-4-1002.
78          Section 4. Section 79-4-1002 is enacted to read:
79          79-4-1002. Antelope Island State Park Improvement restricted account.
80          (1) There is created within the General Fund a restricted account known as the
81     "Antelope Island State Park Improvement restricted account."
82          (2) The account shall consist of:
83          (a) deposits made as described in Sections 23-19-22 and 79-4-1001; and
84          (b) interest on the account.
85          (3) The division shall use money in the account to finance capital improvement
86     projects on Antelope Island, as needed.
