7     LONG TITLE
8     General Description:
9          This bill modifies the responsibilities of the Division of Occupational and Professional
10     Licensing (DOPL).
11     Highlighted Provisions:
12          This bill:
13          ▸     modifies the authority of DOPL to issue licenses to persons who have been
14     previously licensed in another state, district, or territory of the United States or in
15     another country; and
16          ▸     makes technical changes.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 58-1-302 is amended to read:
27          58-1-302. License by endorsement.

28          (1) [(a) The division may] Subject to Subsections (2) and (3), the division shall issue a
29     license without examination to a person who has been licensed in a state, district, or territory of
30     the United States[,] or in a foreign country[, where] if:
31          (a) the division determines the education, experience, and examination requirements
32     [are, or were] of the state, district, or territory of the United States or the foreign country, at the
33     time the license was issued, were substantially equal to the current requirements of this state[.];
34     or
35          (b) after being licensed outside of this state, the person has at least one year of
36     experience in the state, district, or territory of the United States or in the foreign country where
37     the license was issued and the division determines the person has the education, experience,
38     and skills necessary to demonstrate competency in the occupation or profession for which
39     licensure is sought.
40           [(b)] (2) The division, in consultation with the applicable licensing board, may make
41     rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act,
42     prescribing the requirements of [this] Subsection (1).
43          [(2)] (3) Before a person may be issued a license under this section, the person shall
44     produce satisfactory evidence of the person's identity, qualifications, and good standing in the
45     occupation or profession for which licensure is sought.
