7     LONG TITLE
8     General Description:
9          This bill creates the DNA Task Force.
10     Highlighted Provisions:
11          This bill:
12          ▸     creates a task force to study DNA collection, storage, testing, and destruction by the
13     Department of Public Safety.
14     Money Appropriated in this Bill:
15          This bill appropriates in fiscal year 2018.
16          ▸     To the Senate, as a one-time appropriation:
17               •     from the General Fund $4,000 to pay for the salary of the senator serving on the
18     task force; and
19          ▸     To the House of Representatives, as a one-time appropriation:
20               •     from the General Fund $4,000 to pay for the salary of the representative serving
21     on the task force.
22     Other Special Clauses:
23          This bill provides a repeal date.

27     Be it enacted by the Legislature of the state of Utah:
28          Section 1. DNA Task Force -- Creation -- Membership -- Quorum --
29     Compensation -- Staff.
30          (1) There is created the DNA Task Force consisting of the following eight members:
31          (a) one member of the Senate appointed by the president of the Senate;
32          (b) one member of the House of Representatives appointed by the speaker of the House
33     of Representatives;
34          (c) one representative from the Crime Laboratory, appointed by the commissioner of
35     Public Safety;
36          (d) one representative from the Department of Corrections, appointed by the Executive
37     Director of the Department of Corrections;
38          (e) one member of the Sheriff's Association, selected by the membership;
39          (f) one member of the Chiefs of Police Association, selected by the membership;
40          (g) one representative from an association representing prosecutors; and
41          (h) one representative from the Courts, appointed by the Judicial Council.
42          (2) The Senator and Representative shall chair the task force.
43          (3) A majority of the members of the task force constitute a quorum. The action of a
44     majority of a quorum constitutes the action of the task force.
45          (4) (a) Salaries and expenses of the members of the task force who are legislators shall
46     be paid in accordance with Section 36-2-2 and Legislative Joint Rules, Title 5, Chapter 3,
47     Expense and Mileage Reimbursement for Authorized Legislative Meetings, Special Sessions,
48     and Veto Override Sessions.
49          (b) A member of the task force who is not a legislator may not receive compensation
50     for their work associated with the task force, but may receive per diem and reimbursement for
51     travel expenses incurred as a member of the task force at the rates established by the Division
52     of Finance under Sections 63A-3-106 and 63A-3-107.
53          (5) The Office of Legislative Research and General Counsel shall provide staff support
54     to the task force.
55          Section 2. Duties -- Interim report.
56          (1) The task force shall review and make recommendations on the following issues:

57          (a) how to facilitate DNA sample collecting, processing, storing, and destruction;
58          (b) study the feasibility of expanding the law to other categories of arrestees or
59     offenders, and the impact of implementing those samples into existing protocols;
60          (c) study the fiscal impact of adding more people to the sample pool; and
61          (d) study and evaluate the current funding for the state criminal identification database
62     and the state DNA repository.
63          (2) A final report, including any proposed legislation shall be presented to the Law
64     Enforcement and Criminal Justice Interim Committee before November 30, 2017.
65          Section 3. Appropriation.
66          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
67     following sums of money are appropriated from resources not otherwise appropriated, or
68     reduced from amounts previously appropriated, out of the funds or accounts indicated for the
69     fiscal year beginning July 1, 2017 and ending June 30, 2018. These are additions to any
70     amounts previously appropriated for fiscal year 2018.
