7     LONG TITLE
8     General Description:
9          This bill requires the Department of Health to study and report on prescription drug
10     importation.
11     Highlighted Provisions:
12          This bill:
13          ▸     requires the Department of Health to study the importation of certain prescription
14     drugs;
15          ▸     specifies study requirements, including determining how the state may become
16     certified to operate a prescription drug importation program;
17          ▸     requires the department to consult with certain persons; and
18          ▸     requires the department to report its findings and recommendations.

26     Be it enacted by the Legislature of the state of Utah:
27          Section 1. Prescription drug importation study.

28          (1) The Department of Health shall study how to gain approval for the state of Utah to
29     import certain prescription drugs from other countries for eventual consumption by Utah
30     consumers.
31          (2) In the study the department shall:
32          (a) determine how the state of Utah can become certified by the United States Secretary
33     of Health and Human Services to operate a prescription drug importation program;
34          (b) determine how to ensure that only drugs meeting United States Food and Drug
35     Administration safety, effectiveness, and other standards are imported by the state;
36          (c) identify prescription drugs with the highest potential for consumer savings through
37     importation;
38          (d) estimate potential consumer savings attributable to importation;
39          (e) determine with whom the state could contract to distribute imported drugs;
40          (f) determine how to limit the distribution of imported drugs to only Utahns who would
41     benefit most from the associated savings;
42          (g) consult with the Utah State Board of Pharmacy created in Section 58-17b-201,
43     representatives of the pharmaceutical industry, patient advocates, and others representing
44     persons who could be affected by importation; and
45          (h) propose amendments to the Utah Code to facilitate importation by the state.
46          (3) The department shall report the department's findings and recommendations to the
47     Health and Human Services Interim Committee before November 1, 2017.
