8 General Description:
9 This bill modifies provisions related to the Sentencing Commission.
10 Highlighted Provisions:
11 This bill:
12 ▸ defines terms;
13 ▸ requires the Sentencing Commission to:
14 • create a master offense list;
15 • update the master offense list annually; and
16 • present the master offense list to the Law Enforcement and Criminal Justice
17 Interim Committee; and
18 ▸ makes technical and conforming changes.

27 Be it enacted by the Legislature of the state of Utah:
28 Section 1. Section 63M-7-405 is amended to read:
29 63M-7-405. Compensation of members -- Reports to the Legislature, the courts,
30 and the governor.
31 (1) (a) A member who is not a legislator may not receive compensation or benefits for
32 the member's service, but may receive per diem and travel expenses as allowed in:
33 (i) Section 63A-3-106;
34 (ii) Section 63A-3-107; and
35 (iii) rules made by the Division of Finance according to Sections 63A-3-106 and
36 63A-3-107.
37 (b) Compensation and expenses of a member who is a legislator are governed by
38 Section 36-2-2 and Legislative Joint Rules, Title 5, Legislative Compensation and Expenses.
39 (2) (a) The commission shall submit to the Legislature, the courts, and [
40 governor at least 60 days [
41 commission's reports and recommendations for sentencing guidelines and amendments. [

43 (b) The commission [
44 justice agencies. [
45 (c) The commission [
46 staff members as it considers necessary or desirable.
47 (3) The commission shall [
48 three branches of government, but [
49 Justice for coordination on criminal and juvenile justice issues, budget, and administrative
50 support.
51 (4) (a) As used in this Subsection (4), "master offense list" means a document that
52 contains all offenses that exist in statute and each offense's associated penalty.
53 (b) No later than May 1, 2017, the commission shall create a master offense list.
54 (c) No later than June 30 of each calendar year, the commission shall:
55 (i) after the last day of the general legislative session, update the master offense list;
56 and
57 (ii) present the updated master offense list to the Law Enforcement and Criminal
58 Justice Interim Committee.
