7 LONG TITLE
8 General Description:
9 This bill supplements or reduces appropriations previously provided for the use and support
10 of state government for the fiscal years beginning July 1, 2016 and ending June 30, 2017 and
11 beginning July 1, 2017 and ending June 30, 2018.
12 Highlighted Provisions:
13 This bill:
14 ▸ provides budget increases and decreases for the use and support of certain state agencies;
15 ▸ provides budget increases and decreases for the use and support of certain public
16 education programs;
17 ▸ provides budget increases and decreases for the use and support of certain institutions of
18 higher education;
19 ▸ provides funds for the bills with fiscal impact passed in the 2017 General Session;
20 ▸ provides budget increases and decreases for other purposes as described;
21 ▸ provides a mathematical formula for the annual appropriations limit; and,
22 ▸ provides intent language.
23 Money Appropriated in this Bill:
24 This bill appropriates ($30,101,100) in operating and capital budgets for fiscal year 2017,
25 including:
26 ▸ $15,645,100 from the General Fund;
27 ▸ ($20,001,000) from the Education Fund;
28 ▸ ($25,745,200) from various sources as detailed in this bill.
29 This bill appropriates $1,473,000 in expendable funds and accounts for fiscal year 2017,
30 including:
31 ▸ $1,333,000 from the General Fund;
32 ▸ $140,000 from various sources as detailed in this bill.
33 This bill appropriates $104,100 in business-like activities for fiscal year 2017, all of which is
34 from the General Fund.
35 This bill appropriates $728,900 in restricted fund and account transfers for fiscal year 2017,
36 all of which is from the General Fund.
37 This bill appropriates $1,666,000 in transfers to unrestricted funds for fiscal year 2017.
38 This bill appropriates $72,144,400 in operating and capital budgets for fiscal year 2018,
39 including:
40 ▸ $43,129,300 from the General Fund;
41 ▸ $8,000,000 from the Uniform School Fund;
42 ▸ ($20,522,700) from the Education Fund;
43 ▸ $41,537,800 from various sources as detailed in this bill.
44 This bill appropriates $34,055,500 in expendable funds and accounts for fiscal year 2018,

48 This bill appropriates $118,700 in business-like activities for fiscal year 2018.

53 Other Special Clauses:
54 Section 1 of this bill takes effect immediately. Sections 2 and 3 of this bill take effect on

59 Be it enacted by the Legislature of the state of Utah:
60 Section 1. FY 2017 Appropriations. The following sums of money are appropriated for the
61 fiscal year beginning July 1, 2016 and ending June 30, 2017. These are additions to amounts
62 previously appropriated for fiscal year 2017.
63 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
64 Utah Code Title 63J, the Legislature appropriates the following sums of money from the funds or
65 fund accounts indicated for the use and support of the government of the State of Utah.

2135 Section 3. FY 2018 Appropriations Limit Formula.
2136 The state appropriations limit for a given fiscal year, FY, shall be calculated by
2137 , where:
2138 (a) ;
2139 (b) ;
2140 (c) ;
2141 (d) ; and
2142 (e) as used in the state appropriations limit formula:
2143 (i) i is a variable representing a given fiscal year;
2144 (ii) is the net adjustments to the state appropriations limit for a given fiscal year due
2145 to program or service adjustments, as required under Section 63J-3-203;
2146 (iii) is the state capital and operations appropriations from the General
2147 Fund and non-Uniform School fund in fiscal year 1985;
2148 (iv) is the amount the state paid in debt payments in fiscal year 1985;

2149 (v) is the average of the quarterly values of the Gross National Product
2150 Implicit Price Deflator for the fiscal year two fiscal years before FY, as published by the United
2151 States Federal Reserve by January 31 of each year;
2152 (vi) is the average of the quarterly values of the Gross National Product
2153 Implicit Price Deflator for a given fiscal year, as measured by the Gross National Product Implicit
2154 Price Deflator from the vintage series published by the United States Department of Commerce on
2155 January 26, 1990;
2156 (vii) is the change in the general price level of goods and services nationally
2157 from 1983 to two fiscal years before a given fiscal year, as measured by the most current Gross
2158 National Product Implicit Price Deflator series published by the United States Federal Reserve,
2159 adjusted to a 1989 basis;
2160 (viii) is the amount of real per capita state appropriations for fiscal
2161 year 1985; and
2162 (ix) is:
2163 (A) the population as of July 1 in the fiscal year two fiscal years before a given fiscal year,
2164 as estimated by the United States Census Bureau by January 31 of each year; or
2165 (B) if the estimate described in Subsection (3)(e)(ix)(A) is not available, an amount
2166 determined by the Governor's Office of Management and Budget, estimated by adjusting an
2167 available April 1 decennial census count or by adjusting a fiscal year population estimate available
2168 from the United States Census Bureau.
2169 Section 4. Effective Date.
2170 If approved by two-thirds of all the members elected to each house, Section 1 of this bill
2171 takes effect upon approval by the Governor, or the day following the constitutional time limit of
2172 Utah Constitution Article VII, Section 8 without the Governor's signature, or in the case of a veto,
2173 the date of override. Sections 2 and 3 of this bill take effect on July 1, 2017.
