8     LONG TITLE
9     General Description:
10          This bill amends the Emergency Injection for Anaphylactic Reaction Act.
11     Highlighted Provisions:
12          This bill:
13          ▸     amends the definition of epinephrine auto-injector to allow the use of more than one
14     manufacturer of a device.

23     Be it enacted by the Legislature of the state of Utah:
24          Section 1. Section 26-41-102 is amended to read:
25          26-41-102. Definitions.
26          As used in this chapter:
27          (1) "Anaphylaxis" means a potentially life-threatening hypersensitivity to a substance.

28          (a) Symptoms of anaphylaxis may include shortness of breath, wheezing, difficulty
29     breathing, difficulty talking or swallowing, hives, itching, swelling, shock, or asthma.
30          (b) Causes of anaphylaxis may include insect sting, food allergy, drug reaction, and
31     exercise.
32          (2) "Epinephrine auto-injector" means a portable, disposable drug delivery [system
33     with a spring-activated concealed needle that is designed for emergency administration of
34     epinephrine to provide rapid, convenient first-aid for persons] device that contains a measured,
35     single dose of epinephrine that is used to treat a person suffering a potentially fatal anaphylactic
36     reaction.
37          (3) "Qualified adult" means a person who:
38          (a) is 18 years of age or older; and
39          (b) has successfully completed the training program established in Section 26-41-104.
40          (4) "Qualified entity":
41          (a) means a facility or organization that employs, contracts with, or has a similar
42     relationship with a qualified adult who is likely to have contact with another person who may
43     experience anaphylaxis; and
44          (b) includes:
45          (i) recreation camps;
46          (ii) an education facility, school, or university;
47          (iii) a day care facility;
48          (iv) youth sports leagues;
49          (v) amusement parks;
50          (vi) food establishments;
51          (vii) places of employment; and
52          (viii) recreation areas.
