9     LONG TITLE
10     General Description:
11          This joint resolution of the Legislature proposes to amend the Utah Constitution to
12     enact a provision relating to the right to pursue a trade, vocation, occupation, or career.
13     Highlighted Provisions:
14          This resolution proposes to amend the Utah Constitution to:
15          ▸     restrict government from infringing on the right to pursue a trade, vocation,
16     occupation, or career, except in specified circumstances.
17     Special Clauses:
18          This resolution directs the lieutenant governor to submit this proposal to voters.
19          This resolution provides a contingent effective date of January 1, 2020 for this proposal.
20     Utah Constitution Sections Affected:
21     ENACTS:
22          ARTICLE I, SECTION 30

24     Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each
25     of the two houses voting in favor thereof:
26          Section 1. It is proposed to enact Utah Constitution Article I, Section 30, to read:
27          Article I, Section 30. [Right to pursue a trade, vocation, occupation, or career.]

28          Government may not infringe on the individual, inalienable right of the people to
29     pursue an honest trade, vocation, occupation, or career, unless the infringement is narrowly
30     tailored to protect against Ĥ→ [
a present, recognizable] identifiable, likely ←Ĥ , and significant
30a     harm to public health or
31     safety.
32          Section 2. Submittal to voters.
33          The lieutenant governor is directed to submit this proposed amendment to the voters of
34     the state at the next regular general election in the manner provided by law.
35          Section 3. Contingent effective date.
36          If the amendment proposed by this joint resolution is approved by a majority of those
37     voting on it at the next regular general election, the amendment shall take effect on January 1,
38     2020.
