7     LONG TITLE
8     General Description:
9           This bill prohibits certain operations of an unmanned aircraft system related to
10     correctional facilities .
11     Highlighted Provisions:
12          This bill:
13          ▸     defines "correctional facility";
14          ▸      prohibits the operation of an unmanned aircraft system:
15               •     to deliver any item to or inside the property of a correctional facility; or
16               •     in a manner that interferes with the operations or security of a correctional
17     facility;
18          ▸     exempts an unmanned aircraft system that is operating in the course and scope of an
19     operation of a mosquito abatement district; and
20          ▸     makes technical changes .

31     Be it enacted by the Legislature of the state of Utah:
32          Section 1. Section 72-14-102 is amended to read:
33          72-14-102. Definitions.
34          As used in this chapter:
35          (1) "Airport" means the same as that term is defined in Section 72-10-102.
36          (2) "Airport operator" means the same as that term is defined in Section 72-10-102.
37          (3) "Correctional facility" means the same as that term is defined in Section
38     77-16b-102.
39          [(3)] (4) "Unmanned aircraft" means an aircraft that is:
40          (a) capable of sustaining flight; and
41          (b) operated with no possible direct human intervention from on or within the aircraft.
42          [(4)] (5) "Unmanned aircraft system" means the entire system used to operate an
43     unmanned aircraft, including:
44          (a) the unmanned aircraft, including payload;
45          (b) communications equipment;
46          (c) navigation equipment;
47          (d) controllers;
48          (e) support equipment; and
49          (f) autopilot functionality.
50          Section 2. Section 72-14-304 is enacted to read:
51          72-14-304. Unlawful operation of unmanned aircraft near prison facilities --
52     Penalties.
53          (1) An individual may not operate an unmanned aircraft system:
54          (a) to carry or drop any item to or inside the property of a correctional facility; or
55          (b) in a manner that interferes with the operations or security of a correctional facility.

56          (2) (a) A violation of Subsection (1)(a) is a third degree felony.
57          (b) A violation of Subsection (1)(b) is a class B misdemeanor.
58          (3) An operator of an unmanned aircraft system does not violate Subsection (1) if the
59     operator is:
60          (a) an employee or contractor working on behalf of a mosquito abatement district
61     created pursuant to Title 17B, Limited Purpose Local Government Entities - Local Districts, or
62     Title 17D, Limited Purpose Local Government Entities - Other Entities; and
63          (b) acting in the course and scope of the operator's employment.
