8 General Description:
9 This bill modifies the duties of the Agricultural Advisory Board relating to best
10 management practices for agricultural industries.
11 Highlighted Provisions:

13 ▸ modifies the duties of the Agricultural Advisory Board relating to best management
14 practices for certain agricultural industries;

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 4-2-108 is amended to read:
27 4-2-108. Agricultural Advisory Board created -- Composition -- Responsibility --
28 Terms of office -- Compensation.
29 (1) There is created the Agricultural Advisory Board composed of 21 members, with
30 each member representing one of the following:
31 (a) Utah Farm Bureau Federation;
32 (b) Utah Farmers Union;
33 (c) Utah Cattlemen's Association;
34 (d) Utah Wool Growers Association;
35 (e) Utah Dairymen's Association;
36 (f) Utah Pork Producers Association;
37 (g) egg and poultry producers;
38 (h) Utah Veterinary Medical Association;
39 (i) Livestock Auction Marketing Association;
40 (j) Utah Association of Conservation Districts;
41 (k) the Utah horse industry;
42 (l) the food processing industry;
43 (m) the fruit and vegetable industry;
44 (n) the turkey industry;
45 (o) manufacturers of food supplements;
46 (p) a consumer affairs group;
47 (q) dean of the College of Agriculture and Applied Science and vice president of
48 extension from Utah State University;
49 (r) urban and small farmers;
50 (s) Utah Elk Breeders Association;
51 (t) Utah Beekeepers Association; and
52 (u) Utah Fur Breeders Association.
53 (2) [
54 (a) advise the commissioner regarding:
55 (i) the planning, implementation, and administration of the department's programs; and
56 (ii) the establishment of standards governing the care of livestock and poultry,
57 including consideration of:
58 (A) food safety;
59 (B) local availability and affordability of food; and
60 (C) acceptable practices for livestock and farm management[

63 (c) adopt best management practices for sheep, swine, cattle, and poultry industries in
64 the state.
65 (3) The Agricultural Advisory Board may adopt best management practices for
66 domesticated elk, mink, apiaries, and other agricultural industries in the state.
67 (4) For purposes of this section, "best management practices" means practices used by
68 agriculture in the production of food and fiber that are commonly accepted practices, or that are
69 at least as effective as commonly accepted practices, and that:
70 (a) protect the environment;
71 (b) protect human health; and
72 (c) promote the financial viability of agricultural production.

74 the commissioner to four-year terms of office.
75 (b) The commissioner shall appoint representatives of the organizations cited in
76 Subsections (1)(a) through (h) to the Agricultural Advisory Board from a list of nominees
77 submitted by each organization.
78 (c) Notwithstanding the requirements of Subsection [
79 shall, at the time of appointment or reappointment, adjust the length of terms to ensure that the
80 terms of board members are staggered so that approximately half of the board is appointed
81 every two years.
82 (d) Members may be removed at the discretion of the commissioner upon the request
83 of the group they represent.
84 (e) When a vacancy occurs in the membership for any reason, the replacement shall be
85 appointed for the unexpired term.

90 (b) Attendance of 11 members at a duly called meeting constitutes a quorum for the
91 transaction of official business.

93 but may receive per diem and travel expenses in accordance with:
94 (a) Section 63A-3-106;
95 (b) Section 63A-3-107; and
96 (c) rules made by the Division of Finance pursuant to Sections 63A-3-106 and
97 63A-3-107.
