11     General Description:
12          This bill creates a restricted account to receive donations and contributions for certain
13     traffic safety education and outreach programs.
14     Highlighted Provisions:
15          This bill:
16          ▸     creates a restricted account to receive appropriations, donations, and other
17     contributions for traffic safety education and outreach programs;
18          ▸     requires the Department of Transportation to consult with the Department of Public
19     Safety on how to expend funds in the account; and
20          ▸     provides rulemaking authority to allow the department to establish in rule the
21     programs and efforts for which the funds in the account may be expended.

30     Be it enacted by the Legislature of the state of Utah:
31          Section 1. Section 72-2-129 is enacted to read:
32          72-2-129. Transportation Safety Program Restricted Account.
33          (1) There is created in the Transportation Fund the Transportation Safety Program
34     Restricted Account.
35          (2) The account shall be funded by:
36          (a) appropriations to the account by the Legislature;
37          (b) private contributions; and
38          (c) donations or grants from public or private entities.
39          (3) The Legislature shall appropriate funds in the account to the department.
40          (4) Upon appropriation the department may expend up to 5% of the money
41     appropriated under Subsection (3) to administer account distributions in accordance with
42     Subsection (5).
43          (5) (a) Upon appropriation the department shall expend the contributions to fund
44     programs focused on transportation safety including community education and outreach efforts.
45          (b) The department shall consult with the Department of Public Safety to establish an
46     interagency policy to prioritize programs and efforts for which the department may expend
47     account funds.
48          (6) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
49     department may make rules providing procedures and requirements for programs for which the
50     department may expend the funds in the account.
