7     LONG TITLE
8     General Description:
9          This bill modifies provisions related to the Utah State Alice Art Collection.
10     Highlighted Provisions:
11          This bill:
12          ▸     modifies the name of the Utah State Alice Art Collection; and
13          ▸     makes technical changes.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 9-6-305 is amended to read:
26          9-6-305. Art collection committee.
27          (1) (a) The board shall appoint a committee of artists or judges of art to take charge of

28     all works of art acquired under this chapter.
29          (b) This collection shall be known as the [Utah State Alice] State of Utah Alice Merrill
30     Horne Art Collection.
31          (2) (a) Except as required by Subsection (2)(b), as terms of current committee members
32     expire, the board shall appoint each new member or reappointed member to a four-year term.
33          (b) Notwithstanding the requirements of Subsection (2)(a), the board shall, at the time
34     of appointment or reappointment, adjust the length of terms to ensure that the terms of
35     committee members are staggered so that approximately half of the board is appointed every
36     two years.
37          (3) When a vacancy occurs in the membership, the replacement shall be appointed for
38     the unexpired term.
39          (4) A member may not receive compensation or benefits for the member's service, but
40     may receive per diem and travel expenses in accordance with:
41          (a) Section 63A-3-106;
42          (b) Section 63A-3-107; and
43          (c) rules made by the Division of Finance pursuant to Sections 63A-3-106 and
44     63A-3-107.
45          Section 2. Section 9-6-306 is amended to read:
46          9-6-306. Collection.
47          (1) All works of art acquired under this part shall become part of the [Utah State Alice]
48     State of Utah Alice Merrill Horne Art Collection.
49          (2) The art collection shall be held as the property of the state, under control of the
50     division, and may be loaned in whole or in part for exhibition purposes to different parts of the
51     state according to rules prescribed by the board.
52          (3) The division shall take every precaution to avoid damage or destruction to the
53     property of the institute and the art works submitted by exhibitors and shall procure ample
54     insurance on them.
55          (4) All art works shipped to and from the place of exhibition shall be packed by an
56     expert packer.
57          Section 3. Section 63C-9-601 is amended to read:
58          63C-9-601. Responsibility for items.

59          Furniture, furnishings, fixtures, works of art, and decorative objects for which the board
60     has responsibility under this chapter are not subject to the custody or control of the State
61     Library Board, the State Library Division, the Division of Archives and Records Service, the
62     Division of State History, the Office of Museum Services, the Utah Arts Council, the Division
63     of Arts and Museums, the State of Utah Alice Merrill Horne Art Collection Committee, or any
64     other state agency.
