9 This bill creates the Utah Responsible Fatherhood Commission.

32 Be it enacted by the Legislature of the state of Utah:
33 Section 1. Section 62A-18-100 is enacted to read:

35 62A-18-100. Title.
36 This chapter is known as "Responsible Fatherhood."
37 Section 2. Section 62A-18-101 is enacted to read:
38 62A-18-101. Definitions.
39 As used in this chapter:
40 (1) "Account" means the Responsible Fatherhood Restricted Account, created in
41 Section 62A-18-105.
42 (2) "Commission" means the Utah Responsible Fatherhood Commission.
43 Section 3. Section 62A-18-102 is enacted to read:
44 62A-18-102. Utah Commission on Fatherhood and Healthy Relationships.
45 (1) There is created within the department the Utah Responsible Fatherhood
46 Commission consisting of 23 voting members.
47 (2) The members of the commission are:
48 (a) the executive director of the Department of Human Services, or the executive
49 director's designee;
50 (b) the director of the Division of Child and Family Services, or the director's designee;
51 (c) the director of the Division of Juvenile Justice Services, or the director's designee;
52 (d) the director of the Department of Workforce Services, or the director's designee;
53 (e) the director of the Department of Corrections Adult Probation and Parole, or the
54 director's designee;
55 (f) the superintendent of the State Board of Education, or the superintendent's designee;
56 (g) the director of the Office of Recovery Services, or the director's designee;
57 (h) a member appointed by the chief justice of the Utah Supreme Court;
58 (i) six members, appointed by the governor, who are Utah citizens and who have
59 extensive experience in issues related to fatherhood;
60 (j) eight members appointed by the governor, each from a community-based
61 organization that supports at least one of the following groups:
62 (i) victims of domestic violence;
63 (ii) men from a minority ethnic background;
64 (iii) at-risk youth;
65 (iv) men with a substance use disorder;
66 (v) individuals experiencing homelessness;
67 (vi) survivors of domestic violence or sexual assault;
68 (vii) tribal government; or
69 (viii) a parent-teacher association; and
70 (k) a member from the Violence and Injury Prevention Program, within the Division of
71 Disease Control and Prevention, within the Department of Health.
72 (3) A member appointed by the governor shall serve a two-year term and may not serve
73 more than two consecutive terms.
74 (4) When a vacancy occurs in the membership appointed by the governor, the governor
75 shall appoint a replacement for the unexpired term.
76 (5) A member may not receive compensation or benefits for the member's service on
77 the commission.
78 Section 4. Section 62A-18-103 is enacted to read:
79 62A-18-103. Commission chair and vice chair.
80 (1) The voting members of the commission shall elect a chair and a vice chair from
81 among the voting members of the commission.
82 (2) The chair and vice chair shall serve for a term of two years.
83 (3) The chair shall:
84 (a) preside at meetings of the commission; and
85 (b) authorize and execute the actions of the commission.
86 (4) The vice chair shall:
87 (a) assist the chair;
88 (b) if the chair is absent, perform the duties of the chair;
89 (c) accept special assignments from the chair; and
90 (d) perform other duties as delegated by the commission.
91 Section 5. Section 62A-18-104 is enacted to read:
92 62A-18-104. Commission functions and duties.
93 (1) The commission shall meet at least quarterly.
94 (2) A voting member of the commission who fails to attend at least 75% of the
95 meetings in a calendar year is automatically removed from the commission.
96 (3) The commission shall:
97 (a) promote public education concerning the financial and emotional responsibilities of
98 fatherhood;
99 (b) assist men to prepare for the legal, financial, and emotional responsibilities of
100 fatherhood;
101 (c) support the establishment of paternity and financial support of a child;
102 (d) encourage a father, regardless of marital status, to foster his emotional connection
103 to and financial support of his child;
104 (e) establish support mechanisms for a father in his relationship with his child,
105 regardless of his marital or financial status;
106 (f) promote the integration of state and local services available for families;
107 (g) support the training of service providers who work with men whom the commission
108 designates as likely to benefit from fatherhood support initiatives;
109 (h) support efforts to educate men and boys on:
110 (i) methods to prevent and interrupt violence and aggression; and
111 (ii) male health; and
112 (i) support, for men and boys, the development of leadership skills and healthy
113 masculinity.
114 (4) The commission may cooperate with a local, state, or national organization engaged
115 in an activity similar to those described in Subsection (3).
116 (5) (a) The commission may, subject to Title 63J, Chapter 5, Federal Funds Procedures
117 Act, receive and accept federal funds, and may receive and accept private gifts, donations, or
118 funds from any source.
119 (b) Money received under this Subsection (5), except for federal funds, shall be
120 deposited in the account.
121 (6) (a) The commission shall keep a record of the commission's actions.
122 (b) All records of the commission are subject to Title 63G, Chapter 2, Government
123 Records Access and Management Act.
124 (7) The department shall provide administrative and staff support services to the
125 commission.
126 Section 6. Section 62A-18-105 is enacted to read:
127 62A-18-105. Responsible Fatherhood Restricted Account.
128 (1) There is created in the General Fund a restricted account known as the
129 "Responsible Fatherhood Restricted Account."
130 (2) The account shall be funded by non-federal fund contributions described in
131 Subsection 62A-18-104(5)(a), including appropriations by the Legislature.
132 (3) Subject to appropriation, funds in the account shall be used to enable the
133 commission to carry out the duties described in Subsection 62A-18-104(3).
134 Section 7. Appropriation.
135 The following sums of money are appropriated for the fiscal year beginning July 1,
136 2018, and ending June 30, 2019. These are additions to amounts previously appropriated for
137 fiscal year 2019. The Legislature authorizes the State Division of Finance to transfer the
138 following amounts between the following funds or accounts as indicated. Expenditures and
139 outlays from the funds to which the money is transferred must be authorized by an
140 appropriation.
