8 General Description:
9 This bill creates the Zero Emission Vehicle Program.
10 Highlighted Provisions:
11 This bill:
12 ▸ creates the Zero Emission Vehicle Program to:
13 • increase opportunity to purchase low emitting vehicles;
14 • improve ambient air quality; and
15 • coordinate efforts with other states to improve air quality;
16 ▸ requires the Division of Air Quality and the Air Quality Board to administer the
17 program; and
18 ▸ provides rulemaking authority.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 19-2-401 is enacted to read:

32 19-2-401. Title.
33 This part is known as the "Zero Emission Vehicle Program."

37 Section 3. Section 19-2-403 is enacted to read:
38 19-2-403. Zero Emission Vehicle Program -- Rulemaking .
39 (1) There is created the Zero Emission Vehicle Program.
40 (2) In a manner consistent with the federal Clean Air Act, Section 177, 42 U.S.C. Sec.
41 7507, the division shall develop the program to:
42 (a) ensure increased opportunity for the purchase of vehicles that qualify for the
43 program as described in rules made in accordance with Subsection (4); and
44 (b) prevent air pollution and achieve ambient air quality standards within the state.
45 (3) To implement the program, the board and the division:
46 (a) may work in cooperation, and enter into agreements, with other states to administer
47 requirements of the program;
48 (b) shall work in conjunction with other states to promote and facilitate the regional
49 adoption of similar zero emission vehicle programs; and
50 (c) shall make available information on the requirements and details of the program.
51 (4) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, and
52 42 U.S.C. Sec. 7507, the division shall make rules necessary to administer and implement a
53 program under this part.
