10 General Description:
11 This concurrent resolution initiates the replacement of the state's statue of Philo
12 Farnsworth in the United States Capitol with a statue of Dr. Martha Hughes Cannon.
13 Highlighted Provisions:
14 This resolution:
15 ▸ requests that the Joint Committee on the Library of Congress approve the
16 replacement of Utah's statue of Philo Farnsworth in the National Statuary Hall
17 Collection in the United States Capitol with a statue of Dr. Martha Hughes Cannon;
18 and
19 ▸ directs the Governor to oversee the creation of a nonprofit organization to
20 commission a statue of Dr. Martha Hughes Cannon, oversee its placement in the
21 United States Capitol, and oversee the removal of the Philo Farnsworth statue from
22 the United States Capitol.

26 Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
27 WHEREAS, 2 U.S.C. Sec. 2131 allows each state to provide two statues of individuals
28 who were citizens of the state, who are known for their "historic renown or for distinguished
29 civic or military service," for commemoration in the National Statuary Hall Collection in the
30 United States Capitol;
31 WHEREAS, Utah is currently represented by the statues of Brigham Young and Philo
32 Farnsworth;
33 WHEREAS, 2 U.S.C. Sec. 2132 allows a state to request the Joint Committee on the
34 Library of Congress to approve the replacement of a state's statue if:
35 (1) the statue to be replaced has been on display in the United States Capitol for at least
36 10 years; and
37 (2) a replacement request is made through a legislative resolution and approved by the
38 Governor;
39 WHEREAS, the statue of Philo Farnsworth has been on display in the United States
40 Capitol since 1990;
41 WHEREAS, 2 U.S.C. Sec. 2131a requires that an individual's statue may not be placed
42 in the National Statuary Hall Collection until 10 years after the individual's death;
43 WHEREAS, Dr. Martha "Mattie" Hughes Cannon is a renowned woman of Utah, the
44 first female state senator elected in the United States, and a national champion for women's
45 rights;
46 WHEREAS, although the Utah Territory granted women suffrage in 1870, Congress
47 passed the Edmunds-Tucker Act in 1887, revoking women's suffrage in the territory;
48 WHEREAS, the Utah Chapter of the National Woman Suffrage Association was
49 created in 1889 and Dr. Cannon was instrumental in that organization's fight to restore
50 women's right to vote in Utah, which effort was consummated in 1896 with the adoption of the
51 Utah Constitution;
52 WHEREAS, that same year, Dr. Cannon was elected as a member of the Utah Senate
53 and became the first female ever elected as a state senator in the United States, 24 years before
54 all women in the United States were granted the right to vote by the ratification of the
55 nineteenth Amendment to the United States Constitution;
56 WHEREAS, Dr. Cannon defeated her husband and Ŝ→ [
57 obtain her Senate seat;
58 WHEREAS, during her time in the Utah Senate, Dr. Cannon was an outspoken
59 champion for public health issues and was a powerful advocate for women's rights;
60 WHEREAS, Ŝ→ after ←Ŝ Dr. Cannon retired Ŝ→ [
60a Legislature, Ŝ→ [
61 fight for public health improvements, women's rights, and other important public policy
62 improvements until she passed away in 1932; and
63 WHEREAS, Dr. Cannon's faith, resolve, vision, and tireless efforts deserve the highest
64 honors the state can bestow:
65 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the
66 Governor concurring therein, in conformance with 2 U.S.C. 2132, requests that the Joint
67 Committee on the Library of Congress approve the replacement of Utah's statue of Philo
68 Farnsworth in the National Statuary Hall in the United States Capitol with a statue of Dr.
69 Martha Hughes Cannon.
70 BE IT FURTHER RESOLVED that the statue of Dr. Cannon be unveiled in the United
71 States Capitol in August of 2020, in commemoration of the month of the 100th anniversary of
72 the ratification of the nineteenth Amendment to the United States Constitution.
73 BE IT FURTHER RESOLVED that the Governor facilitate the creation of a nonprofit
74 organization that is exempt from federal income tax under Section 501(c), Internal Revenue
75 Code, to:
76 (1) collect charitable contributions to cover all costs associated with the creation and
77 placement of the new statue so that, in conformance with the requirements of 2 U.S.C. Sec.
78 2132, the state bears responsibility for "any costs related to the replacement [statue], including
79 costs in connection with the design, construction, transportation, and placement of the new
80 statue, the removal and transportation of the statue being replaced, and any unveiling
81 ceremony";
82 (2) select a sculptor for the creation of the statue of Dr. Cannon;
83 (3) approve a final design for the sculpture of Dr. Cannon;
84 (4) ensure that the creation and placement of the statue of Dr. Cannon is conducted in a
85 timely and orderly fashion in accordance with this resolution; and
86 (5) ensure that the removal of the existing Philo Farnsworth statue from the United
87 States Capitol is conducted in accordance with this resolution.
88 BE IT FURTHER RESOLVED that no public funds be used for any cost related to the
89 creation and placement of the new statue, including any cost described in the preceding
90 resolved clause.
91 BE IT FURTHER RESOLVED that, in conformance with the requirements of 2 U.S.C.
92 Sec. 2131, the statue be created in marble or bronze.
93 BE IT FURTHER RESOLVED that the Philo Farnsworth statue that is currently
94 located in the United States Capitol be removed and placed in the Utah State Capitol Building.
95 BE IT FURTHER RESOLVED that the Capitol Preservation Board work with the
96 nonprofit organization, whose creation is facilitated by the Governor under this resolution,
97 regarding the movement and placement of statues in the Utah State Capitol Building as
98 directed by this resolution.

102 BE IT FURTHER RESOLVED that a copy of this resolution be mailed to the Joint
103 Committee on the Library of Congress for its consideration.
