8     LONG TITLE
9     General Description:
10          This bill deals with the duties of the Legislative Water Development Commission.
11     Highlighted Provisions:
12          This bill:
13          ▸     removes the sunset date for the Legislative Water Development Commission;
14          ▸     authorizes the Legislative Water Development Commission to meet up to six times
15     per calendar year without approval from the Legislative Management Committee;
16     and
17          ▸     makes technical changes.

28     Be it enacted by the Legislature of the state of Utah:
29          Section 1. Section 63I-1-273 is amended to read:

30          63I-1-273. Repeal dates, Title 73.
31          [(1) Title 73, Chapter 27, State Water Development Commission, is repealed
32     December 31, 2018.]
33          [(2)] The instream flow water right for trout habitat established in Subsection
34     73-3-30(3) is repealed December 31, 2018.
35          Section 2. Section 73-27-103 is amended to read:
36          73-27-103. Duties of commission.
37          (1) The commission shall consider and make recommendations to the Legislature and
38     governor on the following issues:
39          (a) how the water needs of the state's growing municipal and industrial sectors will be
40     met;
41          (b) what the impact of federal regulations and legislation will be on the ability of the
42     state to manage and develop its compacted water rights;
43          (c) how the state will fund water projects;
44          (d) whether the state should become an owner and operator of water projects;
45          (e) how the state will encourage the implementation of water conservation programs;
46     and
47          (f) other water issues of statewide importance.
48          (2) The commission shall:
49          (a) consult with the Division of Water Resources and the Board of Water Resources
50     regarding:
51          (i) recommendations for rules, criteria, targets, processes, and plans described in
52     Subsection 73-10g-105(3); and
53          (ii) the scope of any request for proposals that may be issued by the Division of Water
54     Resources and Board of Water Resources to assist in creating the rules, criteria, targets,
55     processes, and plans described in Subsection 73-10g-105(3); and
56          (b) report the recommendations described in Subsection (2)(a) to the Natural
57     Resources, Agriculture, and Environment Interim Committee and the Legislative Management

58     Committee by October 30, 2016.
59          (3) The commission may:
60          (a) form one or more working groups from the membership of the commission to
61     consider and study the issues described in this section[.]; and
62          (b) meet up to six times per calendar year without approval from the Legislative
63     Management Committee.
