7     LONG TITLE
8     General Description:
9          This bill amends provisions related to dual language immersion.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines terms;
13          ▸     converts the pilot program for dual language immersion into an ongoing program;
14          ▸     requires the State Board of Education to make rules to administer the Dual
15     Language Immersion Program;
16          ▸     provides for the State Board of Education to award a grant to a local education
17     agency for dual language immersion;
18          ▸     describes requirements for a local education agency that receives a grant for dual
19     language immersion;
20          ▸     requires the State Board of Education to provide support to a participating local
21     education agency;
22          ▸     requires the State Board of Education to conduct a program evaluation and report to
23     the Legislature on the results;
24          ▸     repeals a program to provide instruction in certain languages; and
25          ▸     makes technical and conforming changes.

36     Be it enacted by the Legislature of the state of Utah:
37          Section 1. Section 53F-2-502 is repealed and reenacted to read:
38          53F-2-502. Dual language immersion.
39          (1) As used in this section:
40          (a) "Board" means the State Board of Education.
41          (b) "Dual language immersion" means an instructional setting in which a student
42     receives a portion of instruction in English and a portion of instruction exclusively in a partner
43     language.
44          (c) "Local education agency" or "LEA" means a school district or a charter school.
45          (d) "Participating LEA" means an LEA selected by the board to receive a grant
46     described in this section.
47          (e) "Partner language" means a language other than English in which instruction is
48     provided in dual language immersion.
49          (2) The board shall:
50          (a) establish a dual language immersion program;
51          (b) in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act,
52     make rules that establish:
53          (i) a grant program for an LEA to receive funding for dual language immersion;
54          (ii) the required qualifications for an LEA to be a participating LEA;
55          (iii) subject to this section, requirements of a participating LEA;
56          (iv) a proficiency assessment for each partner language; and
57          (v) a progression of how a school in a participating LEA adds grade levels in which the

58     school offers dual language immersion;
59          (c) subject to legislative appropriations:
60          (i) select participating LEAs; and
61          (ii) award to a participating LEA a grant to support dual language immersion in the
62     LEA; and
63          (d) report to a legislative committee on the results of a proficiency assessment
64     described in Subsection (2)(b)(iv) upon request.
65          (3) A participating LEA shall:
66          (a) establish in a school a full-day dual language immersion instructional model that
67     provides at least 50% of instruction exclusively in a partner language;
68          (b) in accordance with the board rules described in Subsection (2)(b), add grades in
69     which dual language immersion is provided in a school; and
70          (c) annually administer to each student in grades 3 through 8 who participates in dual
71     language immersion an assessment described in Subsection (2)(b)(iv).
72          (4) The board shall:
73          (a) provide support to a participating LEA, including by:
74          (i) offering professional learning for dual language immersion educators;
75          (ii) developing curriculum related to dual language immersion; or
76          (iii) providing instructional support for a partner language;
77          (b) conduct a program evaluation of the dual language immersion program established
78     under Subsection (2)(a); and
79          (c) on or before November 1, 2019, report to the Education Interim Committee and the
80     Public Education Appropriations Subcommittee on the results of the program evaluation
81     described in Subsection (4)(b).
82          (5) The board may, in accordance with Title 63G, Chapter 6a, Utah Procurement Code,
83     contract with a third party to conduct the program evaluation described in Subsection (4)(b).
84          Section 2. Repealer.
85          This bill repeals:

86          Section 53F-2-516, Critical Languages Program -- Pilot.
