9 The Executive Appropriations Committee recommended this bill.
10 General Description:
11 This bill supplements or reduces appropriations previously provided for the support and
12 operation of state government for the fiscal year beginning July 1, 2017 and ending June 30, 2018.
13 Highlighted Provisions:
14 This bill:
15 ▸ provides appropriations for the use and support of higher education and certain state
16 agencies;
17 ▸ provides appropriations for other purposes as described; and
18 ▸ provides intent language.
19 Money Appropriated in this Bill:
20 This bill appropriates $153,121,000 in operating and capital budgets for fiscal year 2018,
21 including:
22 ▸ $51,923,700 from the General Fund;
23 ▸ $101,197,300 from various sources as detailed in this bill.
24 This bill appropriates $15,450,000 in expendable funds and accounts for fiscal year 2018,
25 including:
26 ▸ $1,400,000 from the General Fund;
27 ▸ $14,050,000 from various sources as detailed in this bill.
28 This bill appropriates $2,000,000 in business-like activities for fiscal year 2018.
29 This bill appropriates $13,748,100 in restricted fund and account transfers for fiscal year

39 Be it enacted by the Legislature of the state of Utah:
40 Section 1. FY 2018 Appropriations. The following sums of money are appropriated for the
41 fiscal year beginning July 1, 2017 and ending June 30, 2018. These are additions to amounts
42 previously appropriated for fiscal year 2018.
43 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
44 Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of
45 money from the funds or accounts indicated for the use and support of the government of the state of
46 Utah.

53 Under Section 63J-1-603 of the Utah Code, the Legislature
54 intends that appropriations up to $2,000,000 to the Attorney
55 General's Office provided for in Item 13 of Chapter 8 Laws of
56 Utah 2017 not lapse at the close of Fiscal Year 2018. The use
57 of any unused funds is limited to purchase of Information
58 Technology (IT) systems and specific program
59 development/operation, pass-thru funds appropriated by the
60 Legislature and other one-time operational expenses.

To Attorney General - Children's Justice Centers62 Under Section 63J-1-603 of the Utah Code, the Legislature
63 intends that appropriations up to $450,000 to the Attorney
64 General's Office provided for in Item 15 of Chapter 8 Laws of
65 Utah 2017 not lapse at the close of Fiscal Year 2018. The use
66 of any unused funds is limited to costs passed-thru to operate
67 the local CJC's or for one-time operational expenses.

To Attorney General - Contract Attorneys69 Under Section 63J-1-603 of the Utah Code, the Legislature
70 intends that appropriations up to $60,000 provided for contract
71 expense in Item 14 of Chapter 8 Laws of Utah 2017 not lapse
72 at the close of Fiscal Year 2018. The use of any unused funds
73 is limited to professional services for attorneys under contract
74 with the Office of the Attorney General and other litigation
75 expenses.

78 intends that appropriations up to $30,000 to the Attorney
79 General's Office provided for in Item 17 of Chapter 8 Laws of

81 of any unused funds is limited to expense associated with
82 providing domestic violence training.

85 intends that appropriations up to $150,000 provided for the
86 Prosecution Council in Item 16 of Chapter 8 Laws of Utah

88 unused funds is limited to expense associated with providing
89 training and technical assistance to prosecutors.

183 FY 2018. The use of any non-lapsing funds is limited to
184 expenses related to the grand jury.

To Judicial Council/State Court Administrator - Jury and Witness197 Fees
198 Under Section 63J-1-603 of the Utah Code, the Legislature
199 intends that the appropriations of up to $500,000 provided to
200 the Judicial Council/State Court Administrator-Juror, Witness,
201 Interpreter in Laws of Utah 2017 Chapter 8, Item 26 shall not
202 lapse at the close of Fiscal Year 2018. The use of any
203 non-lapsing funds is limited to expenses for jury and witnesses.

To Governor's Office - CCJJ Salt Lake County Jail Bed Housing205 Item 16
206 Under section 63J-1-603 of the Utah Code, the Legislature
207 intends that appropriations up to $700,000 provided for the
208 Commission on Criminal and Juvenile Justice - Salt Lake
209 County Jail Bed Housing in Item 8 of Chapter 476 Laws of
210 Utah 2018 not lapse at the close of fiscal year 2018. The use of
211 any unused funds is limited to contracts between Salt Lake
212 County and other counties to house inmates or for housing Salt
213 Lake County inmates in Oxbow.
214 Notwithstanding the intent language in the Laws of Utah
215 2017, Chapter 476, Item 8, the Legislature intends that the
216 appropriation of $2,857,000 to the Utah Commission on
217 Criminal and Juvenile Justice - Salt Lake County-Bed Housing
218 be used to administer the contracting and payment of funds to
219 any county that contracts with a county of the first class to
220 house prisoners from a correctional facility in the county of
221 first class. The Legislature intends that $2,847,000 be used for
222 housing up to 300 prisoners in county correctional facilities at
223 $26 per day, per prisoner, until FY 2020. The funds may be
224 used to pay for state probationary inmates or parole inmates
225 which the county of the first-class houses or contracts out to
226 other counties. The Legislature intends that payment of these
227 funds be contingent upon a recipient county first entering into a
228 contract between counties according to terms.

To Governor's Office - Character Education230 Under Section 63J-1-603 of the Utah Code, the Legislature
231 intends that appropriations of up to $300,000 provided for the
232 Governor's Office - Character Education in Item 3 of Chapter 8
233 Laws of Utah 2017 not lapse at the close of Fiscal Year 2018.
234 The use of any funds is limited to grants awarded by the
235 Commission on Civic and Character Education.

To Governor's Office - Commission on Criminal and Juvenile237 Justice
238 Under section 63J-1-603 of the Utah Code, the Legislature
239 intends that appropriations up to $1,300,000 provided for the
240 Commission on Criminal and Juvenile Justice Services in Item
241 8 of Chapter 8 Laws of Utah 2017 not lapse at the close of
242 fiscal year 2018. The use of any unused funds is limited to
243 employee incentives, one-time remodeling costs, equipment
244 purchases, one-time DTS projects, research and development
245 contracts, extradition costs, meeting and travel costs, and state
246 pass through grant programs.

252 Fiscal Year 2018. The use of any funds is limited to one-time
253 expenditures authorized by the Constitutional Defense Council.

377 The Legislature intends that should the Division of
378 Emergency Management (DEM) not receive authority to draw
379 down its FY 2018 Emergency Management Performance Grant
380 by June 30, 2018, that funds may be transferred from the
381 Public Safety Program and Operations line item to DEM in FY
382 2018. Should the funds be transferred, then upon approval to
383 draw down the FY 2018 Emergency Management Performance
384 Grant funds, DEM shall transfer back to the Public Safety
385 Programs and Operations line item, the amount originally
386 transferred.
387 In accordance with Utah Code Ann. 24-3-103 the
388 Department of Public Safety is requesting authority to transfer
389 all firearms received from court adjudications (Criminal
390 Evidence) to the department for its use. These firearms will be
391 transferred to the State Crime Laboratory and department
392 training section for official use only. In addition, all
393 ammunition received by the department with these firearms
394 will be used by the State Crime Laboratory and training section
395 for official use only. All other evidentiary property of value
396 that has been adjudicated and received by the department will
397 be transferred to State Surplus for auction.
398 Under section 63J-1-603 of the Utah Code, the Legislature
399 intends that appropriations of up to $10,000,000 provided for

401 line item in Laws of Utah 2017 Chapter 8, Item 28 not lapse at
402 the close of Fiscal Year 2018. This amount excludes any
403 nonlapsing funds from accounts listed under section 63J-1-602.
404 Funding shall be used for equipment, technology, emergencies,
405 transfers to JBA or JDA line items to cover shortfalls, and
406 other one-time operating expenses.
407 According to Senate Bill 198 passed in the 2017 General
408 Session, a public safety answering point shall maintain in a
409 separate emergency telecommunications service fund any
410 funds dispersed to the public safety answering point from the
411 Tax Commission under Section 69-2-302, from proceeds of the
412 911 emergency services charge levied under Section 69-2-402.
413 This bill also stated that any unexpended funds at the end of a
414 fiscal year in a public safety answering point's emergency
415 telecommunications service fund not lapse. However, this was
416 not coordinated with Section 63J-1-602.5 List of Nonlapsing
417 Funds and Accounts Title 64 and Thereafter. The Legislature
418 intends that these funds not lapse at the end of FY2018 and
419 shall be used as outlined in Section 69-2-301.
420 The Legislature intends that any proceeds from the sale of
421 the salvaged helicopter parts and any insurance
422 reimbursements for helicopter repair be used by the department
423 for its operations.

729 waiver or state plan amendment in which Medicaid would
730 identify families who have a child that is receiving one of these
731 very expensive medications and if that medical condition is a
732 known genetic condition that can be identified by in vitro
733 fertilization then Medicaid would offer and cover in vitro
734 fertilization services to those families so they would know that
735 any subsequent children that they wished to have would not be
736 afflicted with the same medical condition.
