23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 26-18-24 is enacted to read:
25 26-18-24. Five-year waiting period for legal aliens seeking Medicaid or Children's
26 Health Insurance Program benefits.
27 (1) As used in this section:
28 (a) "Five-year waiting period" means the limited eligibility of qualified aliens for
29 federal means-tested public benefits described in 8 U.S.C. Sec. 1613.
30 (b) "Qualified alien" means the same as that term is defined in 8 U.S.C. Sec. 1641.
31 (2) The department shall, to the fullest extent allowable under federal and state law,
32 require a five-year waiting period for a qualified alien to receive benefits through the Medicaid
33 program or the Utah Children's Health Insurance Program, created in Chapter 40, Utah
34 Children's Health Insurance Act.
