SECONDARY WATER METERING REQUIREMENTS

7     LONG TITLE
8     General Description:
9          This bill addresses the metering of pressurized secondary water.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines terms;
13          ▸     requires a secondary water provider that begins providing new secondary water
14     service on or after January 1, 2020, to meter the use of water;
15          ▸     phases in requirements for a secondary water provider to meter the use of secondary
16     water for residential, commercial, industrial, or institutional users; and
17          ▸     requires a secondary water provider to provide water use data to the state engineer
18     and the Division of Water Rights.

27     Be it enacted by the Legislature of the state of Utah:
28          Section 1. Section 73-10-34 is enacted to read:
29          73-10-34. Secondary water metering.
30          (1) As used in this section:
31          (a) "Secondary water" means water that is:
32          (i) not culinary or agricultural water; and
33          (ii) delivered to and used by an end consumer for the irrigation of landscaping or
34     gardens.
35          (b) "Secondary water supplier" means an entity that supplies pressurized secondary
36     water to at least 500 connections.
37          (2) A secondary water supplier that begins providing new service on or after January 1,
38     2020, shall meter the use of secondary water by an end consumer receiving new service.
39          (3) A secondary water supplier that primarily supplies pressurized secondary water to:
40          (a) commercial, industrial, or institutional users shall meter the use of secondary water
41     by July 1, 2026; and
42          (b) residential users shall meter the use of secondary water by July 1, 2028.
43          (4) A secondary water supplier shall collect the data from required water meters and
44     provide that data to the state engineer and the Division of Water Resources.
