10     LONG TITLE
11     General Description:
12          This joint resolution authorizes the Utah State Developmental Center's governing board
13     to approve the sale or long-term lease of 143 acres of land and water rights.
14     Highlighted Provisions:
15          This resolution:
16          ▸     recognizes the important role the Utah State Developmental Center plays in the
17     provision of resources and support for disabled individuals with complex or acute
18     needs in Utah; and
19          ▸     authorizes the Utah State Developmental Center's governing board to approve the
20     sale or long-term lease of 143 acres of land and water rights.
21     Special Clauses:
22          None

24     Be it resolved by the Legislature of the state of Utah:
25          WHEREAS, Utah Code Subsection 62A-5-206.6(5) requires that the Utah State
26     Developmental Center's governing board obtain the approval of the Legislature before offering
27     real property or water rights associated with the Utah State Developmental Center (USDC) for

28     sale, exchange, or long-term lease;
29          WHEREAS, in 1929 the Legislature established the Utah State Training Center to assist
30     with the care, protection, treatment, and education of individuals with intellectual disabilities;
31          WHEREAS, the Utah State Training Center, later known as the USDC, was established
32     during an era when relatively little was known about the causes of intellectual disabilities;
33          WHEREAS, like other states, Utah built a public institution in a remote location and
34     within a broad perimeter of land that provided a physical barrier between the institution and the
35     nearest rural homes and communities;
36          WHEREAS, since its establishment in 1929, the USDC has evolved and improved in
37     determining what public services should be provided for individuals with intellectual
38     disabilities and how to provide those services;
39          WHEREAS, since state governments first acknowledged a public interest in and
40     accepted some fiscal responsibility for citizens with intellectual disabilities, states have made
41     sweeping changes in the philosophy and practice of providing public services to those citizens;
42          WHEREAS, these paradigm shifts have resulted from a growing knowledge about
43     intellectual disabilities, including their causes, preventions, interventions, and
44     accommodations;
45          WHEREAS, also contributing to the paradigm shifts was an improving regard for
46     individuals who experience intellectual disabilities, as evidenced by public laws that affirm and
47     promote their rights, an expansion of publicly funded services, and greater inclusion by their
48     communities;
49          WHEREAS, the USDC's mission is "dedication to providing an array of resources and
50     supports for individuals with disabilities with complex or acute needs in Utah";
51          WHEREAS, the USDC's vision is to "provide an effective, efficient array of critical
52     services and supports that promote independence and quality of life for Utah's most vulnerable
53     individuals with disabilities in partnership with families, guardians and the community"; and
54          WHEREAS, the sale or long-term lease of real property and water rights associated
55     with the USDC may provide long-term financial stability of the USDC to enable the USDC to
56     continue to accomplish its mission and vision:
57          NOW, THEREFORE, BE IT RESOLVED that the Legislature, in accordance with Utah
58     Code Subsection 62A-5-206.6(5), authorizes the Utah State Developmental Center's governing

59     board to offer for sale or long-term lease 143 acres of land and water rights, inclusive of the 7.7
60     acres authorized by the Legislature in 2017, located on the north end of the USDC's campus,
61     and recognizes that this may include the sale of land to construct an east-west connector road
62     and may include the sale or long-term lease of land to construct a fire station for American
63     Fork.
64          BE IT FURTHER RESOLVED that the Legislature urges the governing board to accept
65     the offer or offers that provide for the best long-term financial stability of the USDC, which
66     may be a sale of the land and water rights and, in accordance with Utah Code Section
67     62A-5-206.6, the investment of the proceeds of the sale.
