7     LONG TITLE
8     General Description:
9          This bill delays action by the lieutenant governor in changing a county's classification.

21     Be it enacted by the Legislature of the state of Utah:
22          Section 1. Section 17-50-502 is amended to read:
23          17-50-502. Change of class of county.
24          (1) Each county shall retain its classification under Section 17-50-501 until changed as
25     provided in this section.
26          (2) The lieutenant governor shall monitor the population figure for each county as
27     shown on:
28          (a) each official census or census estimate of the United States Bureau of the Census;
29     or

30          (b) if the population figure for a county is not available from the United States Bureau
31     of the Census, the population estimate from the Utah Population Committee.
32          (3) [If] After July 1, 2021, if the applicable population figure under Subsection (2)
33     indicates that a county's population has increased beyond the limit for its current class, the
34     lieutenant governor shall:
35          (a) prepare a certificate indicating the class in which the county belongs based on the
36     increased population figure; and
37          (b) within 10 days after preparing the certificate, deliver a copy of the certificate to the
38     county legislative body and, if the county has an executive that is separate from the legislative
39     body, the executive of the county whose class was changed.
40          (4) A county's change in class is effective on the date of the lieutenant governor's
41     certificate under Subsection (3).
42          Section 2. Effective date.
43          If approved by two-thirds of all the members elected to each house, this bill takes effect
44     upon approval by the governor, or the day following the constitutional time limit of Utah
45     Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
46     the date of veto override.
