10     LONG TITLE
11     General Description:
12          This bill requires the Department of Transportation to implement a program to provide
13     safe routes to school.
14     Highlighted Provisions:
15          This bill:
16          ▸     requires the Department of Transportation to establish a program to promote safe
17     routes for walking and bicycling to schools;
18          ▸     allows the department to use available funds as prioritized by the Transportation
19     Commission;
20          ▸     allows the Department of Transportation to give priority to routes in areas of low
21     income schools; and
22          ▸     grants rulemaking authority to the Department of Transportation to implement the
23     program.

32     Be it enacted by the Legislature of the state of Utah:
33          Section 1. Section 72-8-109 is enacted to read:
34          72-8-109. Safe Routes to School Program.
35          (1) As part of providing for the safety of the state transportation system, the department
36     shall establish a program that promotes walking and bicycling to school through infrastructure
37     improvements and noninfrastructure efforts such as safety awareness education.
38          (2) In addition to any federal funds made available to the department for the program,
39     the department may fund the program from money made available to the department by the
40     Legislature and as prioritized by the commission.
41          (3) The department, in consultation with the State Board of Education, may give
42     priority consideration to a project located in an area of a school that receives funding under the
43     Elementary and Secondary Education Act of 1965, Title I, 20 U.S.C. Sec. 6301, et seq.
44          (4) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
45     department may make rules to implement this section.
