13 This bill addresses wood burning.
14 Highlighted Provisions:
15 This bill:
16 ▸ modifies the type of wood burning for conversions;
17 ▸ modifies the requirements to be eligible for the conversion program;
18 ▸ directs the division to give preference to applicants for conversions who meet
19 certain criteria; and
20 ▸ makes technical changes.

32 Be it enacted by the Legislature of the state of Utah:
33 Section 1. Section 19-2-107.5 is amended to read:
34 19-2-107.5. Solid fuel burning.
35 (1) The division shall create a[
36 representatives of the solid fuel burning industry, the healthcare industry, and members of the
37 clean air community, on best wood burning practices and the effects of wood burning on air
38 quality, specifically targeting nonattainment areas[
39 [
40 an individual to convert a dwelling to a natural gas, propane, [
41
42 electric heating source, as funding allows, if the individual[
43 wood burning [
44 [
45 (b) In creating the program described in Subsection (2)(a), the division shall give
46 preference to applicants who:
47 (i) have an adjusted gross household income of 250% or less of the federal poverty
48 level;
49 (ii) live in a house where wood is the sole or supplemental source of heating; or
50 (iii) live within six miles of the Great Salt Lake Base and Meridian.

52 specified seasonal period of time.
53 (b) Notwithstanding Subsection [
54 (i) allow burning:
55 (A) during local emergencies and utility outages; or
56 (B) if the primary purpose of the burning is to cook food; and
57 (ii) provide for exemptions, through registration with the division, for:
58 (A) devices that are sole sources of heat; or
59 (B) locations where natural gas service is limited or unavailable.

61 supplement any funds appropriated by the Legislature to fulfill Subsection [
62 Section 2. Appropriation.
63 The following sums of money are appropriated for the fiscal year beginning July 1,
64 2018, and ending June 30, 2019. These are additions to amounts previously appropriated for
65 fiscal year 2019. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
66 Act, the Legislature appropriates the following sums of money from the funds or accounts
67 indicated for the use and support of the government of the state of Utah.

73 The Legislature intends that this appropriation pay for the conversion of wood stoves
74 and fireplaces as provided in Section 19-2-107.5. Under Section 63J-1-603 the Legislature
75 intends that appropriations provided under this section not lapse at the close of fiscal year
76 2019. The use of any nonlapsing funds is limited to conversion of wood stoves and fireplaces
77 as provided in Section 19-2-107.5.
