8 LONG TITLE
9 General Description:
10 This resolution grants the Legislature's approval for certain state entities to enter into a
11 settlement agreement to resolve a pending lawsuit.
12 Highlighted Provisions:
13 This resolution:
14 ▸ gives approval to the settlement agreement negotiated by the parties and approved
15 by the governor in the case Christensen et al. v. Miner et al., Case No. 2:18-cv-0037
16 (United States District Court for the District of Utah).

20 Be it resolved by the Legislature of the state of Utah:
21 WHEREAS, the Department of Health and other state entities and employees of Utah
22 were sued by the Disability Law Center and a prospective class of Utah Medicaid eligible
23 individuals with intellectual or developmental disabilities;
24 WHEREAS, the parties have entered into a final settlement agreement;
25 WHEREAS, pursuant to Utah Code Section 63G-10-302, the governor has approved
26 that settlement agreement;
27 WHEREAS, Utah Code Section 63G-10-303 requires the Legislature to approve a
28 settlement agreement that legally binds the state to take action that might cost government
29 entities more than $1,000,000 to implement; and
30 WHEREAS, the cost of implementing the settlement agreement will exceed
31 $1,000,000:
32 NOW, THEREFORE, BE IT RESOLVED by the Legislature that the Legislature
33 approves the final draft of the settlement agreement and action plan in the case of Christensen
34 et al. v. Miner et al.
