7     LONG TITLE
8     General Description:
9          This bill requires that jails must continue to allow female prisoners access to
10     contraceptives.
11     Highlighted Provisions:
12          This bill:
13          ▸     provides that jails must provide women prisoners with the option of continuing any
14     medically prescribed method of contraception.

23     Be it enacted by the Legislature of the state of Utah:
24          Section 1. Section 17-22-8 is amended to read:
25          17-22-8. Care of prisoners -- Funding of services -- Private contractor.
26          (1) Except as provided in Subsection (3), the sheriff shall:
27          (a) receive all persons committed to jail by competent authority;

28          (b) provide [them] all prisoners with necessary food, clothing, and bedding in the
29     manner prescribed by the county legislative body; [and]
30          (c) provide medical care when:
31          (i) the [person's] prisoner's symptoms evidence a serious disease or injury;
32          (ii) the [person's] prisoner's disease or injury is curable or may be substantially
33     alleviated; and
34          (iii) the potential for harm to the [person] prisoner by reason of delay or the denial of
35     medical care would be substantial; and
36          (d) provide female prisoners as part of the intake process with the option of continuing
37     any medically prescribed method of contraception.
38          (2) The expense incurred in providing these services to prisoners shall be paid from the
39     county treasury, except as provided in Section 17-22-10.
40          (3) If the county executive contracts with a private contractor to provide the services
41     required by this section, the sheriff shall provide only those services required of him by the
42     contract between the county and the private contractor.
