9 This bill modifies provisions of the Apprenticeship Act.

27 Be it enacted by the Legislature of the state of Utah:
28 Section 1. Section 35A-6-102 is amended to read:
29 35A-6-102. Definitions.
30 As used in this chapter and in Title 34, Labor in General:
31 (1) "Apprentice" means an individual [
32 (a) a written agreement approved by the [
33 Office of Apprenticeship with an employer or the employer's agent, an association of
34 employers, an organization of employees, or a joint committee representing employers and
35 employees; [
36 (b) an apprenticeship that meets [
37 Office of Apprenticeship standards; or
38 (c) an apprenticeship that can be completed at no charge to the participant where the
39 participant learns and works to learn a set of skills that result in the participant qualifying for a
40 state license or certification or earning industry recognized credentials at the completion of the
41 apprenticeship.
42 (2) "Commissioner" means the Commissioner of Apprenticeship Programs described
43 in Section 35A-6-105.

45 the federal agency designated by the United States Department of Labor to oversee
46 apprenticeship programs.
47 Section 2. Section 35A-6-105 is enacted to read:
48 35A-6-105. Commissioner of Apprenticeship Programs.
49 (1) There is created the position of Commissioner of Apprenticeship Programs within
50 the department.
51 (2) The commissioner shall be appointed by the executive director and chosen from
52 one or more recommendations provided by a majority vote of the State Workforce
53 Development Board.
54 (3) The commissioner may be terminated without cause by the executive director.
55 (4) The commissioner shall:
56 (a) promote and educate the public, including high school guidance counselors and
57 potential participants in apprenticeship programs, about apprenticeship programs offered in the
58 state, including apprenticeship programs offered by private sector businesses, trade groups,
59 labor unions, partnerships with educational institutions, and other associations in the state;
60 (b) coordinate with the department and other stakeholders, including the Utah System
61 of Technical Colleges, union and nonunion apprenticeship programs, the Office of
62 Apprenticeship, the State Board of Education, the Utah System of Higher Education, the
63 Department of Commerce, the Division of Occupational and Professional Licensing, and the
64 Governor's Office of Economic Development to improve and promote apprenticeship
65 opportunities in the state; and
66 (c) provide an annual written report to:
67 (i) the department for inclusion in the department's annual written report described in
68 Section 35A-1-109;
69 (ii) the Business, Economic Development, and Labor Appropriations Subcommittee;
70 and
71 (iii) the Higher Education Appropriations Subcommittee.
72 (5) The annual written report described in Subsection (4)(c) shall provide information
73 concerning:
74 (a) the number of available apprenticeship programs in the state;
75 (b) the number of apprentices participating in each program;
76 (c) the completion rate of each program;
77 (d) the cost of state funding for each program; and
78 (e) recommendations for improving apprenticeship programs.
