75 Be it enacted by the Legislature of the state of Utah:
76 Section 1. Section 13-32a-102 is amended to read:
77 13-32a-102. Definitions.
78 As used in this chapter:
79 (1) "Account" means the Pawnbroker and Secondhand Merchandise Operations
80 Restricted Account created in Section 13-32a-113.
81 (2) "Antique item" means an item:
82 (a) that is generally older than 25 years;
83 (b) whose value is based on age, rarity, condition, craftsmanship, or collectability;
84 (c) that is furniture or other decorative objects produced in a previous time period, as
85 distinguished from new items of a similar nature; and
86 (d) obtained from auctions, estate sales, other antique shops, and individuals.
87 (3) "Antique shop" means a business operating at an established location [
88
89 (4) "Board" means the Pawnshop and Secondhand Merchandise Advisory Board
90 created by this chapter.
91 (5) "Central database" or "database" means the electronic database created and
92 operated under Section 13-32a-105.
93 (6) "Children's product" means a used item that is for the exclusive use of children, or
94 for the care of children, including clothing and toys.
95 (7) "Children's product resale business" means a business operating at a commercial
96 location and primarily selling children's products.
97 (8) "Coin" means a piece of currency, usually metallic and usually in the shape of a
98 disc that is:
99 (a) stamped metal, and issued by a government as monetary currency; or
100 (b) (i) worth more than its current value as currency; and
101 (ii) worth more than its metal content value.
102 (9) "Coin dealer" means a person [
103 selling and purchasing of [
104 (10) "Collectible paper money" means paper currency that is no longer in circulation
105 and is sold and purchased for the paper currency's collectible value.

107 monetized bullion, art bars, medallions, medals, tokens, and currency that are marked by the
108 refiner or fabricator indicating their fineness and include:
109 [
110 metals; or

112 (b) "Commercial grade precious metals" or "precious metals" does not include jewelry.
113 (12) "Consignment shop" means a business, operating at an established location:
114 (a) that deals primarily in the offering for sale property owned by a third party; and
115 (b) where the owner of the property only receives consideration upon the sale of the
116 property by the business.

122 (14) "Exonumia" means a privately issued token for trade that is sold and purchased
123 for the token's collectible value.
124 (15) "Gift card" means a record that:
125 (a) is usable at:
126 (i) a single merchant; or
127 (ii) a specified group of merchants;
128 (b) is prefunded before the record is used; and
129 (c) can be used for the purchase of goods or services.
130 (16) "Identification" means any of the following non-expired forms of identification
131 issued by a state government, the United States government, or a federally recognized Indian
132 tribe, if the identification includes a unique number, photograph of the bearer, and date of birth:
133 (a) a United States Passport or United States Passport Card;
134 (b) a state-issued driver license;
135 (c) a state-issued identification card;
136 (d) a state-issued concealed carry permit;
137 (e) a United States military identification;
138 (f) a United States resident alien card;
139 (g) an identification of a federally recognized Indian tribe; or
140 (h) notwithstanding Section 53-3-207, a Utah driving privilege card.
141 (17) "Indicia of being new" means property that:
142 (a) is represented by the individual pawning or selling the property as new;
143 (b) is unopened in the original packaging; or
144 (c) possesses other distinguishing characteristics that indicate the property is new.

174 (a) an extension of credit in which an individual delivers property to a pawnbroker for
175 an advance of money and retains the right to redeem the property for the redemption price
176 within a fixed period of time[
177 (b) a loan of money on one or more deposits of personal property;
178 (c) the purchase, exchange, or possession of personal property on condition of selling
179 the same property back again to the pledgor or depositor; or
180 (d) a loan or advance of money on personal property by the pawnbroker taking chattel
181 mortgage security on the personal property, taking or receiving the personal property into the
182 pawnbroker's possession, and selling the unredeemed pledges.
183 (23) "Pawnbroker" means a person whose business:
184 (a) engages in a pawn transaction; or
185 (b) holds itself out as being in the business of a pawnbroker or pawnshop, regardless of
186 whether the person or business enters into pawn transactions or secondhand merchandise
187 transactions.
188 (24) "Pawnshop" means the physical location or premises where a pawnbroker
189 conducts business.

250 (30) "Secondhand merchandise transaction" means the purchase or exchange of used or
251 secondhand property.
252 (31) "Ticket" means a document upon which information is entered when a pawn
253 transaction or secondhand merchandise transaction is made.
254 (32) "Transaction card" means a card, code, or other means of access to a value with
255 the retail business issued to a person that allows the person to obtain, purchase, or receive any
256 of the following:
257 (a) goods;
258 (b) services;
259 (c) money; or
260 (d) anything else of value.
261 Section 2. Section 13-32a-103 is amended to read:

272 (1) A retail business engaging in a transaction involving a transaction card or gift card
273 issued by that retail business and that bears the branding of that retail business is not subject to
274 this chapter.
275 (2) A pawn or secondhand business may not purchase or pawn a gift card or transaction
276 card.
277 (3) This chapter does not prohibit a pawn or secondhand business from issuing or
278 accepting as payment a gift card that:
279 (a) is issued solely by the pawn or secondhand business; and
280 (b) bears the brand or name of the pawn or secondhand business.

323 merchandise transaction on behalf of the pawn or secondhand business or the initials or a
324 unique identifying number of the individual, if the pawn or secondhand business maintains a
325 record of the initials or unique identifying number of the individual; and

327 available identifying marks [
328 (i) names, brand names, numbers, serial numbers, model numbers, color,
329 manufacturers' names, and size;
330 (ii) metallic composition, and any jewels, stones, or glass;
331 (iii) any other marks of identification or indicia of ownership on the [
332 (iv) the weight of the [
333 (v) any other unique identifying feature;
334 (vi) gold content, if indicated; [
335 (vii) if multiple articles of property of a similar nature are delivered together in one
336 transaction and the articles of property do not bear serial or model numbers and do not include
337 precious metals or gemstones, such as musical or video recordings, books, or hand tools, the
338 description of the articles is adequate if it includes the quantity of the articles and a description
339 of the type of articles delivered.
340 (2) (a) A pawn or secondhand business may not accept [
341 inspection, it is apparent that [
342
343 (i) a serial number or another form of indicia of ownership has been removed, altered,
344 defaced, or obliterated;
345 (ii) the property is not a numismatic item and has indicia of being new, but is not
346 accompanied by a written receipt or other satisfactory proof of ownership other than the seller's
347 own statement; or
348 (iii) except as provided in Subsection 13-32a-103.1(3), the property is a gift card,
349 transaction card, or other physical or digital card or certificate evidencing store credit.
350 (b) A pawn or secondhand business is not subject to Subsection (2)(a)(ii) if the pawn or
351 secondhand business is the original seller of the property and is accepting a return of the
352 property as provided by the pawn or secondhand business' established return policy.
353 (c) Property is presumed to have had indicia of being new at the time of a transaction if
354 the property is subsequently advertised by the pawn or secondhand business as being new.
355 (3) (a) [
356 regulated under this chapter if the property is subject to being turned over to a law enforcement
357 agency in accordance with Title 77, Chapter 24a, Lost or Mislaid Personal Property.
358 (b) If an individual attempts to sell or pawn property to a business regulated under this
359 chapter and the employee or owner of the business knows or has reason to know that the
360 property is subject to Title 77, Chapter 24a, Lost or Mislaid Personal Property, the employee or
361 owner shall advise the individual of the requirements of Title 77, Chapter 24a, Lost or Mislaid
362 Personal Property, and may not receive the property in pawn or sale.
363 (4) A coin dealer is subject to Section 13-32a-104.5 and not subject to this section.

366 (6) (a) On and after January 1, 2020:
367 (i) a pawn or secondhand business shall obtain an electronic legible fingerprint of the
368 individual's right index finger that can be submitted to the central database at the same time the
369 other information is submitted under this section, or if the right index finger cannot be
370 fingerprinted, an electronic legible fingerprint of the individual with a notation on the ticket
371 identifying the fingerprint and the reason why a right index fingerprint is unavailable; and
372 (ii) the electronic fingerprint is not required on the ticket.
373 (b) On and after January 1, 2020, a pawn or secondhand business shall submit an
374 electronic legible fingerprint obtained under Subsection (6)(a) to the central database.
375 (7) On and after January 1, 2020, a pawn or secondhand business shall obtain:
376 (a) a color digital photograph clearly and accurately depicting:
377 (i) each item of jewelry, including scrap jewelry and watches; and
378 (ii) if an item of jewelry, including scrap jewelry and watches, has one or more
379 engravings, an additional color digital photograph specifically depicting any engraving; and
380 (b) a color digital photograph of an item that bears an identifying mark, including:
381 (i) a serial number, engraving, owner label, or similar identifying mark; and
382 (ii) an additional photograph that clearly depicts the identifying mark described in
383 Subsection (7)(b)(i).
384 Section 6. Section 13-32a-104.5 is amended to read:
385 13-32a-104.5. Database information from coin dealers -- New and prior
386 customers.
387 (1) A coin dealer shall maintain [

421 (iii) any other marks of identification or indicia of ownership on the article;
422 (iv) the weight of the article, if the payment is based on weight;
423 (v) any other unique identifying feature; and
424 (vi) metallic content.
425 (3) (a) If multiple [
426 amount that would make reporting of each item unreasonably difficult are part of a single sale
427 transaction, [

430 (b) The description for a grouping described in Subsection (3)(a) must be an accurate
431 description, with available identifying marks, including:
432 (i) type and name of numismatic items or type and content of precious metal;
433 (ii) metallic composition, and any jewels, stones, or glass;
434 (iii) any other marks of identification or indicia of ownership on the article;
435 (iv) the weight of the articles, if the payment is based on the weight;
436 (v) any other unique identifying features; and
437 (vi) metallic content.
438 (4) If the [
439 coin dealer has an established previous transaction history with the coin dealer, the coin dealer
440 or the coin dealer's employee shall [
441 [
442 (a) the date and time of the transaction and the ticket number;
443 (b) indication that the coin dealer has conducted business with the seller previously;
444 (c) [

446 secondhand business or the initials or unique identifying number, if the coin dealer maintains a
447 record of the initials or unique identifying number of the individual;
448 (d) the initials of the seller's legal name, including any middle name;
449 (e) form of identification presented by the seller at the time of sale;
450 (f) the last four digits of the unique identifying number on the form of identification;
451 [
452 (g) the individual's signature;
453 (h) the amount paid for or trade-in value of each numismatic item or precious metal;
454 and
455 [
456 applicable.
457 (5) A coin dealer may not accept any [
458 inspection, it is apparent that serial numbers or identifying characteristics have been
459 intentionally defaced on that [
460 (6) (a) On and after January 1, 2020:
461 (i) for a secondhand merchandise transaction described in Subsection (1), a coin dealer
462 shall obtain an electronic legible fingerprint of the individual's right index finger that can be
463 submitted to the central database at the same time the other information is submitted under this
464 section, or if the right index finger cannot be fingerprinted, an electronic legible fingerprint of
465 the individual with a notation on the ticket identifying the fingerprint and the reason why a
466 right index fingerprint is unavailable; and
467 (ii) the electronic fingerprint is not required on the ticket.
468 (b) On and after January 1, 2020, a pawn or secondhand business shall submit an
469 electronic legible fingerprint obtained under Subsection (6)(a) to the central database.
470 Section 7. Section 13-32a-105 is amended to read:

482 (2) The division shall:
483 (a) establish and operate the central database; or
484 (b) contract with a third party to establish and operate the central database in
485 accordance with Title 63G, Chapter 6a, Utah Procurement Code.
486 (3) Funding for the creation and operation of the central database shall be from the
487 account.

498 (5) (a) Beginning January 1, 2020, upon a query by a pawnbroker, the central database
499 shall provide notification of the volume of business an individual seeking to enter into a
500 transaction with the pawnbroker has engaged in with any pawnbroker regulated by this chapter
501 within the previous 30 days based on the records in the central database at the time of the
502 query.

505 Section 8. Section 13-32a-106 is amended to read:
506 13-32a-106. Transaction information provided to the central database --
507 Protected information.
508 (1) (a) [
509 compatible format information required to be recorded under Sections 13-32a-103 [
510 13-32a-104, and 13-32a-104.5 that is capable of being transmitted electronically [
511
512 24 hours after entering into the transaction.
513 (b) The division may specify by rule, made in accordance with Title 63G, Chapter 3,
514 Utah Administrative Rulemaking Act, the information capable of being transmitted
515 electronically under Subsection (1)(a).
516 (2) [
517 generated by the [
518 manner so that the tickets are available to local law enforcement agencies as required by this
519 chapter and as requested by any law enforcement agency as part of an investigation or
520 reasonable random inspection conducted pursuant to this chapter.
521 (3) (a) If a pawn or secondhand business experiences a computer or electronic
522 malfunction that affects its ability to report transactions as required in Subsection (1), the pawn
523 or secondhand business shall immediately notify the division and the local law enforcement
524 agency of the malfunction.
525 (b) The pawn or secondhand business shall solve the malfunction within three business
526 days or notify the division and the local law enforcement agency under Subsection (4).
527 (4) If the computer or electronic malfunction under Subsection (3) cannot be solved
528 within three business days, the pawn or secondhand business shall notify the division and the
529 local law enforcement agency of the reasons for the delay and provide documentation from a
530 reputable computer maintenance company of the reasons why the computer or electronic
531 malfunction cannot be solved within three business days.
532 (5) A computer or electronic malfunction does not suspend the pawn or secondhand
533 business' obligation to comply with all other provisions of this chapter.
534 (6) During the malfunction under Subsections (3) and (4), the pawn or secondhand
535 business shall:
536 (a) arrange with the local law enforcement agency a mutually acceptable alternative
537 method by which the pawn or secondhand business provides the required information to the
538 local law enforcement [
539 (b) a [
540 other related information required under this chapter in a written form.
541 (7) A pawn or secondhand business that violates the electronic transaction reporting
542 requirement of this section is subject to an administrative fine of $50 per day if:
543 (a) the pawn or secondhand business is unable to submit the information electronically
544 due to a computer or electronic malfunction;
545 (b) the three business day period under Subsection (3) has expired; and
546 (c) the pawn or secondhand business has not provided documentation regarding its
547 inability to solve the malfunction as required under Subsection (4).
548 (8) A pawn or secondhand business is not responsible for a delay in transmission of
549 information that results from a malfunction in the central database.
550 (9) A pawnbroker is not responsible for a transaction in violation of Subsection
551 13-32a-110.5(2) if, at the time of the transaction, the pawnbroker is unable to query the central
552 database as a result of a malfunction of the central database.

557 (1) [

567 (b) investigating a possible violation of the record keeping or reporting requirements of
568 this chapter when the local law enforcement [
569 of the records and information received, has reason to believe that a violation has occurred;
570 (c) responding to an inquiry from an insurance company investigating a claim for
571 physical loss of described property by searching the central database to determine if property
572 matching the description has been delivered to a [
573 by another person in a pawn transaction or secondhand merchandise purchase transaction and if
574 so, obtaining from the central database:
575 (i) a description of the property;
576 (ii) the name and address of the [
577 received the property; and
578 (iii) the name, address, and date of birth of the conveying [
579 (d) taking enforcement action under Section 13-2-5 against a [
580 secondhand business.
581 (2) An insurance company making a request under Subsection (1)(c) shall provide the
582 police report case number concerning the described property.
583 (3) (a) A person may not knowingly and intentionally use, release, publish, or

606 13-32a-109. Holding period for property -- Return of property -- Penalty.
607 (1) (a) A pawnbroker may sell [
608 (i) 15 calendar days have passed [

611 (ii) the contract period between the pawnbroker and the pledgor [

613 (iii) the pawnbroker has complied with [
614 13-32a-103, 13-32a-104, and 13-32a-106 [

644 property when the prosecution takes over the case.
645 (3) If [
646 hold on the property, the property shall remain in the custody of the pawn or secondhand
647 business until further disposition by the law enforcement agency, and as consistent with this
648 chapter.
649 (4) The initial hold by a law enforcement agency is for a period of 90 days. If the
650 [
651 remain in the custody of the pawn or secondhand business and is subject to the hold unless
652 exigent circumstances require the [
653 law enforcement agency.
654 (5) (a) A law enforcement agency may extend any hold for up to an additional 90 days
655 [
656 (b) [
657 law enforcement agency shall notify the pawn or secondhand business that is subject to the
658 hold prior to the expiration of the initial 90 days.
659 (c) A law enforcement agency may not hold an item for more than the 180 days
660 allowed under Subsections (5)(a) and (b) without obtaining a court order authorizing the hold.
661 (6) A hold on [
662 request to claim or purchase the [
663 (7) [
664 victim who has complied with Section 13-32a-115 has not been identified and the hold or
665 seizure of the property is terminated, the law enforcement agency requiring the hold or seizure
666 shall within 15 business days after the termination:
667 (a) notify the pawn or secondhand business in writing that the hold or seizure has been
668 terminated;
669 (b) return the [
670 business; or
671 (c) if the [
672 the pawn or secondhand business either in writing or electronically of the specific alternative
673 disposition of the [
674 (8) (a) [
675 original victim who has complied with Section 13-32a-115 has been identified and the hold or
676 seizure of property is terminated, the law enforcement agency requiring the hold or seizure
677 shall:
678 (i) document the original victim who has positively identified the [
679 and
680 (ii) provide the documented information concerning the original victim to the
681 prosecuting agency to determine whether continued possession of the [
682 necessary for purposes of prosecution, as provided in Section 24-3-103.
683 (b) If the prosecuting agency determines that continued possession of the [
684 property is not necessary for purposes of prosecution, as provided in Section 24-3-103, the
685 prosecuting agency shall provide a written or electronic notification to the law enforcement
686 agency [
687 complied with Section 13-32a-115.
688 (c) (i) A law enforcement agency shall promptly provide notice to the pawn or
689 secondhand business of the authorized return of the [
690 (ii) The notice shall identify the original victim, advise the pawn or secondhand
691 business that the original victim has identified the [
692 secondhand business to release the [
693 original victim[
694 (iii) If the [
695 property will be returned to the original victim within 15 days after the day on which the pawn
696 or secondhand business receives the notice, except as provided under Subsection (8)(d).
697 (d) The pawn or secondhand business shall release [
698 Subsection (8)(c) unless within 15 days of receiving the notice the pawn or secondhand
699 business complies with Section 13-32a-116.5.
700 (9) If the law enforcement agency does not notify the pawn or secondhand business
701 that a hold on [
702 letter by registered or certified mail to the law enforcement agency that ordered the hold and
703 inform the agency that the holding period has expired. The law enforcement agency shall
704 respond within 30 days by:
705 (a) confirming that the [
706 secondhand business may manage the [
707 business; or
708 (b) providing written notice to the pawn or secondhand business that a court order has
709 continued the period of time for which the item shall be held.
710 (10) The written notice under Subsection (9)(b) is considered provided when:
711 (a) personally delivered to the pawn or secondhand business with a signed receipt of
712 delivery;
713 (b) delivered to the pawn or secondhand business by registered or certified mail; or
714 (c) delivered by any other means with the mutual assent of the law enforcement agency
715 and the pawn or secondhand business.
716 (11) If the law enforcement agency does not respond within 30 days under Subsection
717 (9), the pawn or secondhand business may manage the [
718 ordinary course of business.
719 (12) A violation of this section is a class B misdemeanor and is also subject to civil
720 penalties under Section 13-32a-110.
721 Section 12. Section 13-32a-109.5 is amended to read:
722 13-32a-109.5. Seizure of property -- Notification to pawn or secondhand business.
723 If a law enforcement agency determines seizure of property pawned or sold to a pawn
724 or secondhand business is necessary under this chapter during the course of a criminal
725 investigation, in addition to the [
726 enforcement agency shall:
727 (1) notify the [
728 to be seized; and
729 (2) issue to the [
730 form approved by the division and that:
731 (a) provides the active case number related to the [
732 (b) provides the date of the seizure request;
733 (c) provides the reason for the seizure;

765 (2) Except as provided in Subsection (3), on and after January 1, 2020, a pawnbroker
766 may not enter into a transaction with an individual who, including the transaction being
767 proposed, will have engaged within the previous 30 days, with a pawnbroker regulated by this
768 chapter, in:
769 (a) more than four transactions; or
770 (b) one or more transactions, if the total of items of property involved in the total of
771 transactions is more than 10.
772 (3) A pawnbroker may engage in a transaction with an individual in excess of the
773 limitations described in Subsection (2) if the pawnbroker determines that the transaction being
774 proposed is a pawn transaction and the transaction involves an item of property that:
775 (a) has a serial number or unique identifying mark; and
776 (b) has been pawned and redeemed by the same individual with the pawnbroker within
777 the previous 30 days.

856 (3) After receiving a recommendation for a member by a respective association,
857 council, or industry for the board, the executive director may:
858 (a) decline the recommendation; and
859 (b) request another recommendation from the respective association, council, or
860 industry.

875 employed by, or an entity that the member is representing, engages in a violation of this chapter
876 or Section 76-6-408.
877 (e) Notwithstanding Subsection (4)(d), members of the board as of May 13, 2019, are
878 removed from the board and the executive director of the Department of Commerce shall
879 appoint the board members in accordance with this section.

923 once each year regarding compliance with this chapter and other applicable state laws.
924 (b) A pawn or secondhand business shall ensure that each individual employed by the
925 pawn or secondhand business with access to the central database annually completes the
926 training described in Subsection (1)(a) in order for that individual to continue to have access to
927 the central database.
928 (c) A law enforcement agency participating in the use of the central database shall
929 ensure that each individual employed by the law enforcement agency with access to the central
930 database annually completes the training described in Subsection (1)(a) in order for that
931 individual to continue to have access to the central database.
932 (2) The division shall monitor and keep a record of training completion.

974 (2) Subsection (1) does not preclude a city, county, or other local governmental unit
975 from:
976 (a) enacting or enforcing local ordinances concerning public health, safety, or welfare,
977 if the ordinances are uniform and equal in application to pawn and secondhand businesses and
978 other retail businesses or activities;
979 (b) requiring a pawn or secondhand business to obtain and maintain a business license
980 and providing for revocation of the business license based on multiple violations of Section
981 76-6-408; and
982 (c) enacting zoning ordinances that restrict areas where pawn or secondhand businesses
983 and other retail businesses or activities can be located.
984 Section 21. Section 13-32a-115 is amended to read:
985 13-32a-115. Criminal investigation -- Prosecution -- Property disposition.
986 (1) If the property pawned or sold to a pawn or secondhand business is the subject of a
987 criminal investigation and a hold has been placed on the property under Section 13-32a-109,
988 the original victim shall do the following to establish a claim:
989 (a) positively identify to law enforcement the [
990 (b) if a police report has not already been filed for the original theft or loss of property,
991 file a police report, and provide for the law enforcement agency information surrounding the
992 original theft or loss of property; and
993 (c) give a sworn statement under penalty of law that:
994 (i) claims ownership of the property;
995 (ii) references the original theft or loss; and
996 (iii) identifies the perpetrator if known.
997 (2) The pawn or secondhand business shall retain possession of any property subject to
998 a hold until a criminal prosecution is commenced relating to the property for which the hold
999 was placed unless:
1000 (a) during the course of a criminal investigation the actual physical possession by law
1001 enforcement of [
1002 [
1003 contains unique or sensitive personal identifying information; or
1004 (b) an agreement between the original victim and the pawn or secondhand business to
1005 return the property is reached.
1006 (3) (a) Upon the commencement of a criminal prosecution, any [
1007 subject to a hold for investigation under this chapter may be seized by the law enforcement
1008 agency [
1009 (b) Subsequent disposition of the property shall be consistent with this chapter.
1010 (4) At all times during the course of a criminal investigation and subsequent
1011 prosecution, the [
1012 pawn or secondhand business subject to the hold unless [
1013 purchased property has been seized by the law enforcement agency pursuant to Section
1014 13-32a-109.5.
1015 Section 22. Section 13-32a-116 is amended to read:

1026 (1) If a pawn or secondhand business [
1027 enforcement agency under Section 13-32a-109 that [
1028 subject of a hold or seizure shall be returned to an identified original victim, the pawn or
1029 secondhand business may contest the determination and seek a specific alternative disposition
1030 if within 15 business days after the day on which the pawn or secondhand business receives the
1031 notice:
1032 (a) the pawn or secondhand business gives notice to the identified original victim, by
1033 certified mail, that the pawn or secondhand business contests the determination to return the
1034 [
1035 (b) files a petition in a court having jurisdiction over the matter to determine rightful
1036 ownership of the [
1037 (2) A pawn or secondhand business is guilty of a class B misdemeanor if the pawn or
1038 secondhand business:
1039 (a) holds or sells [
1040 enforcement agency that the [
1041 (b) the pawn or secondhand business does not comply with the requirements of this
1042 section within the time periods specified.
1043 Section 24. Section 76-6-408 is amended to read:
1044 76-6-408. Receiving stolen property -- Duties of pawnbrokers, secondhand
1045 businesses, and coin dealers.
1046 (1) As used in this section:
1047 (a) "Pawnbroker" means the same as that term is defined in Section 13-32a-102.
1048 (b) "Receives" means acquiring possession, control, title, or lending on the security of
1049 the property.

1104 76-6-412. Theft -- Classification of offenses -- Action for treble damages.
1105 (1) Theft of property and services as provided in this chapter is punishable:
1106 (a) as a second degree felony if the:
1107 (i) value of the property or services is or exceeds $5,000;
1108 (ii) property stolen is a firearm or an operable motor vehicle; or
1109 (iii) property is stolen from the person of another;
1110 (b) as a third degree felony if:
1111 (i) the value of the property or services is or exceeds $1,500 but is less than $5,000;
1112 (ii) the value of the property or services is or exceeds $500 and the actor has been twice
1113 before convicted of any of the following offenses, if each prior offense was committed within
1114 10 years of the date of the current conviction or the date of the offense upon which the current
1115 conviction is based and at least one of those convictions is for a class A misdemeanor:
1116 (A) any theft, any robbery, or any burglary with intent to commit theft;
1117 (B) any offense under Title 76, Chapter 6, Part 5, Fraud; or
1118 (C) any attempt to commit any offense under Subsection (1)(b)(ii)(A) or (B);
1119 (iii) in a case not amounting to a second degree felony, the property taken is a stallion,
1120 mare, colt, gelding, cow, heifer, steer, ox, bull, calf, sheep, goat, mule, jack, jenny, swine,
1121 poultry, or a fur-bearing animal raised for commercial purposes; or
1122 (iv) (A) the value of property or services is or exceeds $500 but is less than $1,500;
1123 (B) the theft occurs on a property where the offender has committed any theft within
1124 the past five years; and
1125 (C) the offender has received written notice from the merchant prohibiting the offender
1126 from entering the property pursuant to Subsection 78B-3-108(4);
1127 (v) the actor has been previously convicted of a felony violation of any of the offenses
1128 listed in Subsections (1)(b)(ii)(A) through (1)(b)(ii)(C);
1129 (c) as a class A misdemeanor if:
1130 (i) the value of the property stolen is or exceeds $500 but is less than $1,500;
1131 (ii) (A) the value of property or services is less than $500;
1132 (B) the theft occurs on a property where the offender has committed any theft within
1133 the past five years; and
1134 (C) the offender has received written notice from the merchant prohibiting the offender
1135 from entering the property pursuant to Subsection 78B-3-108(4); or
1136 (iii) the actor has been twice before convicted of any of the offenses listed in
1137 Subsections (1)(b)(ii)(A) through (1)(b)(ii)(C), if each prior offense was committed within 10
1138 years of the date of the current conviction or the date of the offense upon which the current
1139 conviction is based; or
1140 (d) as a class B misdemeanor if the value of the property stolen is less than $500 and
1141 the theft is not an offense under Subsection (1)(c).
1142 (2) Any individual who violates Subsection 76-6-408[
1143 76-6-413(1), or commits theft of property described in Subsection 76-6-412(1)(b)(iii), is civilly
1144 liable for three times the amount of actual damages, if any sustained by the plaintiff, and for
1145 costs of suit and reasonable attorney fees.
