7     LONG TITLE
8     General Description:
9          This bill requires the State Board of Regents to conduct a study and report to the
10     Legislature.
11     Highlighted Provisions:
12          This bill:
13          ▸     requires the State Board of Regents to:
14               •     study tuition waivers and scholarships;
15               •     study indicators of student success; and
16               •     report to the Higher Education Appropriations Subcommittee; and
17          ▸     provides a repeal date.

21          This bill provides a coordination clause.

31     Be it enacted by the Legislature of the state of Utah:
32          Section 1. Section 53B-8-114 is enacted to read:
33          53B-8-114. Study of tuition waivers and scholarships -- Study of student success
34     indicators -- Report to Legislature.
35          (1) The board shall study:
36          (a) the statewide impacts of state-created tuition waivers and scholarships, including:
37          (i) the amount of tuition waived and scholarships granted, including the proportion of
38     tuition waivers and scholarships for resident students and nonresident students;
39          (ii) the benefits and fiscal impacts of state-created tuition waivers and scholarships;
40          (iii) the process by which students apply for tuition waivers and scholarships, and
41     whether that process can be consolidated across higher education institutions that are part of
42     the Utah System of Higher Education described in Section 53B-1-102;
43          (iv) the performance of students who receive state-created tuition waivers or state
44     scholarships, including retention, completion, and state workforce participation; and
45          (v) other issues related to the statewide goals and impacts of tuition waivers and
46     scholarships, as determined by the board; and
47          (b) the use of uniform indicators to measure student success, including by analyzing for
48     each institution of higher education that is part of the Utah System of Higher Education
49     described in Section 53B-1-102:
50          (i) the first-year student retention rate; and
51          (ii) the completion rate.
52          (2) On or before November 1, 2019, the board shall report to the Higher Education
53     Appropriations Subcommittee on:
54          (a) the results of the study described in Subsection (1); and
55          (b) any recommendations related to tuition waivers, scholarships, or uniform student
56     success indicators based on the results.

57          Section 2. Section 63I-2-253 is amended to read:
58          63I-2-253. Repeal dates -- Titles 53 through 53G.
59          (1) Section 53A-24-602 is repealed July 1, 2018.
60          (2) (a) Subsections 53B-2a-103(2) and (4) are repealed July 1, 2019.
61          (b) When repealing Subsections 53B-2a-103(2) and (4), the Office of Legislative
62     Research and General Counsel shall, in addition to its authority under Subsection 36-12-12(3),
63     make necessary changes to subsection numbering and cross references.
64          (3) (a) Subsection 53B-2a-108(5) is repealed July 1, 2022.
65          (b) When repealing Subsection 53B-2a-108(5), the Office of Legislative Research and
66     General Counsel shall, in addition to its authority under Subsection 36-12-12(3), make
67     necessary changes to subsection numbering and cross references.
68          (4) (a) Subsection 53B-7-705(6)(b)(ii)(A), the language that states "Except as provided
69     in Subsection (6)(b)(ii)(B)," is repealed July 1, 2021.
70          (b) Subsection 53B-7-705(6)(b)(ii)(B) is repealed July 1, 2021.
71          (5) (a) Subsection 53B-7-707(4)(a)(ii), the language that states "Except as provided in
72     Subsection (4)(b)," is repealed July 1, 2021.
73          (b) Subsection 53B-7-707(4)(b) is repealed July 1, 2021.
74          (6) Section 53B-8-114 is repealed July 1, 2020.
75          [(6)] (7) (a) The following sections are repealed on July 1, 2023:
76          (i) Section 53B-8-202;
77          (ii) Section 53B-8-203;
78          (iii) Section 53B-8-204; and
79          (iv) Section 53B-8-205.
80          (b) (i) Subsection 53B-8-201(2) is repealed on July 1, 2023.
81          (ii) When repealing Subsection 53B-8-201(2), the Office of Legislative Research and
82     General Counsel shall, in addition to its authority under Subsection 36-12-12(3), make
83     necessary changes to subsection numbering and cross references.
84          [(7)] (8) Title 53B, Chapter 18, Part 14, Uintah Basin Air Quality Research Project, is
85     repealed July 1, 2023.
86          [(8)] (9) Subsection 53E-5-306(3)(b)(ii)(B) is repealed July 1, 2020.
87          [(9)] (10) Section 53E-5-307 is repealed July 1, 2020.

88          [(10)] (11) Subsections 53F-2-205(4) and (5), the language that states "or 53F-2-301.5,
89     as applicable" is repealed July 1, 2023.
90          [(11)] (12) Subsection 53F-2-301(1) is repealed July 1, 2023.
91          [(12)] (13) Subsection 53F-2-515(1), the language that states "or 53F-2-301.5, as
92     applicable" is repealed July 1, 2023.
93          [(13)] (14) Section 53F-4-204 is repealed July 1, 2019.
94          [(14)] (15) Section 53F-6-202 is repealed July 1, 2020.
95          [(15)] (16) Subsection 53F-9-302(3), the language that states "or 53F-2-301.5, as
96     applicable" is repealed July 1, 2023.
97          [(16)] (17) Subsection 53F-9-305(3)(a), the language that states "or 53F-2-301.5, as
98     applicable" is repealed July 1, 2023.
99          [(17)] (18) Subsection 53F-9-306(3)(a), the language that states "or 53F-2-301.5, as
100     applicable" is repealed July 1, 2023.
101          [(18)] (19) Subsection 53G-3-304(1)(c)(i), the language that states "or 53F-2-301.5, as
102     applicable" is repealed July 1, 2023.
103          [(19)] (20) On July 1, 2023, when making changes in this section, the Office of
104     Legislative Research and General Counsel shall, in addition to the office's authority under
105     Subsection 36-12-12(3), make corrections necessary to ensure that sections and subsections
106     identified in this section are complete sentences and accurately reflect the office's perception of
107     the Legislature's intent.
108          Section 3. Coordinating H.B. 454 with S.B. 14 -- Substantive language.
109          If this H.B. 454 and S.B. 14, Education Reporting Requirements, both pass and become
110     law, it is the intent of the Legislature that the Office of Legislative Research and General
111     Counsel prepare the Utah Code database for publication by:
112          (1) inserting the following language as a new Subsection 53B-1-301(2)(a):
113          "(a) the report by the State Board of Regents on a study described in Section
114     53B-8-114;"; and
115          (2) renumbering remaining subsections accordingly.
