6     LONG TITLE
7     General Description:
8          This rules resolution addresses procedures for calendaring legislation.
9     Highlighted Provisions:
10          This resolution:
11          ▸     creates a procedure to request that certain pieces of House legislation be placed on
12     the Senate third reading calendar during the last two days of an annual general
13     session.

20     Be it resolved by the House of Representatives of the state of Utah:
21          Section 1. HR3-1-107 is enacted to read:
22          HR3-1-107. Calendaring of legislation on 44th and 45th day of an annual general
23     session.
24          (1) On the 44th day of an annual general session, House leadership shall provide the
25     Senate with a priority list, created in accordance with this section, that contains a list of House
26     legislation that the House of Representatives recommends the Senate place on the Senate third
27     reading calendar.

28          (2) (a) Before the House of Representatives adjourns on the 43rd day of an annual
29     general session, and in a manner established by House leadership, each representative may
30     submit to House leadership up to two pieces of House legislation for inclusion on a priority list
31     described in Subsection (1).
32          (b) (i) If a representative submits two pieces of House legislation for the priority list,
33     the representative shall designate one as the representative's first priority and one as the
34     representative's second priority, in order of preference.
35          (ii) If a representative submits one piece of House legislation for the priority list, that
36     piece of House legislation is designated as the representative's first priority.
37          (3) (a) Except as provided in Subsection (3)(b), a representative may submit a piece of
38     House legislation for inclusion on the priority list only if:
39          (i) the legislation received:
40          (A) the requisite votes to pass the House of Representatives on third reading;
41          (B) a favorable recommendation from a House Standing Committee as required by
42     HR3-2-401; and
43          (C) a favorable recommendation from a Senate Standing Committee as required by
44     SR3-2-401; and
45          (ii) the representative is the chief sponsor.
46          (b) Consistent with HR3-2-401 and SR3-2-401, Subsections (3)(a)(i)(B) and (C) do not
47     apply to:
48          (i) a resolution regarding legislative rules or legislative personnel;
49          (ii) legislation that has been approved by a unanimous vote of an interim committee;
50          (iii) the revisor's statute; or
51          (iv) if the legislation was reviewed and approved by the Executive Appropriations
52     Committee, legislation that:
53          (A) exclusively appropriates money;
54          (B) amends Utah Code Title 53F, Chapter 2, State Funding -- Minimum School
55     Program;
56          (C) amends Utah Code Title 67, Chapter 22, State Officer Compensation; or
57          (D) authorizes the issuance of a general obligation bond or a revenue bond.
58          (4) Once a representative submits a piece of House legislation to House leadership for

59     inclusion on the priority list, the representative may not remove the piece of House legislation
60     from the priority list and submit a different piece of House legislation.
61          (5) (a) Subject to Subsection (5)(b), House leadership shall list the House legislation
62     submitted for inclusion on the priority list in the following order:
63          (i) House legislation that the chief sponsor designates as a first priority, in the order the
64     House legislation passed the House of Representatives; and
65          (ii) House legislation that the chief sponsor designates as a second priority, in the order
66     the House legislation passed the House of Representatives.
67          (b) The speaker may place up to six pieces of House legislation anywhere on the
68     priority list that the speaker chooses, regardless of whether the speaker is the chief sponsor.
69          (6) To comply with this rule, the House of Representatives shall adopt a process to
70     keep a record of the order in which House legislation passes the House of Representatives.
71          (7) Except as provided in Subsection (8), the House of Representatives may not request
72     that the Senate:
73          (a) place the House legislation listed on the priority list on its third reading calendar in
74     an order that is different from the order in which it appears on the priority list; or
75          (b) place on its third reading calendar House legislation that is not on the priority list.
76          (8) After the Senate acts on the priority list, the House of Representatives may
77     recommend that the Senate place additional pieces of House legislation on the Senate third
78     reading calendar in accordance with a process established by House leadership.
79          (9) The prioritization described in this section is in addition to prioritizing fiscal note
80     bills as required under JR4-5-101.
