8 General Description:
9 This bill modifies provisions related to vessels.
10 Highlighted Provisions:
11 This bill:
12 ▸ enacts criminal provisions related to registration decals or cards;
13 ▸ provides for enforcement of maintenance inspection programs for vessels carrying
14 passengers for hire; and
15 ▸ makes technical changes.

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 73-18-7.2 is amended to read:
27 73-18-7.2. Falsified or misused registration or certificate of title.
28 (1) It is a third degree felony for [
29 [
30 registration card, or registration decal or outboard motor certificate of title issued by the
31 division or [
32 [
33 registration card, or registration decal or outboard motor certificate of title purporting to have
34 been issued by the division or [
35 [
36 outboard motor certificate of title; or
37 [
38 or registration decal or outboard motor certificate of title knowing it has been altered, forged,
39 or falsified.
40 (2) It is a class C misdemeanor for a person to use or permit the use or display of a
41 registration decal or registration card on a motorboat or sailboat or in the operation of a
42 motorboat or sailboat other than the motorboat or sailboat for which the registration decal or
43 registration card is issued.
44 Section 2. Section 73-18-20 is amended to read:
45 73-18-20. Enforcement of chapter -- Authority to stop and board vessels --
46 Disregarding law enforcement signal to stop as misdemeanor -- Procedure for arrest.
47 (1) [
48 Officer Classifications, may enforce [
49 this chapter, and the maintenance inspection program for vessels carrying passengers for hire
50 implemented under this chapter.
51 (2) [
52 Officer Classifications, has the authority to stop and board [
53 chapter, whether the vessel is on water or land. If that law enforcement officer determines the
54 vessel is overloaded, unseaworthy, or the safety equipment required by this chapter or rules of
55 the board is not on the vessel, that law enforcement officer may prohibit the launching of the
56 vessel or stop the vessel from operating.
57 (3) An operator who, having received a visual or audible signal from a law
58 enforcement officer authorized under Title 53, Chapter 13, Peace Officer Classifications, to
59 bring the operator's vessel to a stop, operates the vessel in willful or wanton disregard of the
60 signal so as to interfere with or endanger the operation of [
61 individual, or who attempts to flee or elude the law enforcement officer whether by vessel or
62 otherwise is guilty of a class A misdemeanor.
63 (4) Whenever [
64 this chapter or a rule made under this chapter, the procedure for arrest is the same as described
65 in Sections 77-7-23 and 77-7-24.
