7     LONG TITLE
8     General Description:
9          This bill amends provisions of the Election Code relating to becoming a candidate for
10     the office of State Board of Education member.
11     Highlighted Provisions:
12          This bill:
13          ▸     clarifies that an individual may run for the office of State Board of Education
14     member as a member of a political party, as unaffiliated, or as a write-in candidate;
15     and
16          ▸     makes technical and conforming changes.
17     Money Appropriated in this Bill:
18          None
19     Other Special Clauses:
20          This bill provides a special effective date.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 20A-14-104.1 is amended to read:
27          20A-14-104.1. State Board of Education -- Candidacy.

28          (1) A person interested in becoming a candidate for the office of State Board of
29     Education member shall:
30          (a) file a declaration of candidacy [according to the procedures and requirements of] in
31     accordance with Sections 20A-9-201 and 20A-9-202[.];
32          (b) file a certificate of nomination in accordance with Sections 20A-9-501, 20A-9-502,
33     and 20A-9-503; or
34          (c) seek placement on the ballot as a write-in candidate in accordance with Sections
35     20A-9-601 and 20A-9-602.
36          (2) The office of State Board of Education member [is a partisan office.] may be filled
37     by an individual running as a member of a political party, as unaffiliated, or as a write-in
38     candidate.
39          Section 2. Effective date.
40          If approved by two-thirds of all the members elected to each house, this bill takes effect
41     upon approval by the governor, or the day following the constitutional time limit of Utah
42     Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
43     the date of veto override.
