8 General Description:
9 This bill prohibits a court from transferring an action without the consent of the person
10 bringing the action in certain circumstances.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 78B-3-310 is amended to read:
26 78B-3-310. Court to which transfer is to be made.
27 (1) If jurisdiction and venue are proper in a court in which an action is filed, the court
28 may not transfer the action to another court, regardless of whether the other court is within the
29 same district, without the consent of the person bringing the action.
30 (2) (a) An action or proceeding which is transferred by order of the court shall be
31 transferred to a court agreed upon by the parties.
32 (b) If the parties do not agree on a court under Subsection (2)(a), the action shall be
33 transferred to the nearest court where the objection or reason for transfer does not exist.
