7     LONG TITLE
8     General Description:
9          This bill permits an LEA to adopt separate schedules for employees who provide
10     certain Ĥ→ [
special] ←Ĥ education related medical services in a school-based setting.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms; and
14          ▸     permits an LEA to adopt a separate salary schedule or separate salary schedules for
15     employees who provide certain Ĥ→ [
special] ←Ĥ education related medical services in a
16     school-based setting.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 53G-7-218 is enacted to read:
27          53G-7-218. Medical specialists in public schools.

28          (1) As used in this section:
29          (a) "Qualified individual" means an individual who:
30          (i) is employed by an LEA; and
31          (ii) provides related services in a school-based setting.
32          (b) "Qualified individual" includes:
33          (i) an audiologist;
34          (ii) a speech-language pathologist;
35          (iii) a mental health practitioner;
36          (iv) a nurse;
37          (v) an occupational therapist; and
38          (vi) a physical therapist.
39          (c) "Related services" means the same as that term is defined in 34 C.F.R. 300.34.
40          (2) An LEA may adopt a salary schedule, or salary schedules for qualified individuals,
41     that:
42          (a) is separate from salary schedules adopted for other LEA employees; and
43          (b) takes into consideration the market rate for related services provided outside of a
44     school-based setting.
