9     LONG TITLE
10     General Description:
11          This bill creates disclosure requirements related to inmate commissary accounts.
12     Highlighted Provisions:
13          This bill:
14          ▸     defines terms; and
15          ▸     requires correctional facilities to disclose potential policies or practices regarding
16     inmate commissary accounts.

25     Be it enacted by the Legislature of the state of Utah:
26          Section 1. Section 17-22-33 is enacted to read:
27          17-22-33. Commissary account disclosure requirements.
28          (1) As used in this section:

29          (a) "Commissary account" means an account from which an inmate may withdraw
30     money, deposited by the inmate or another individual, to purchase discretionary items for sale
31     by a correctional facility.
32          (b) "Commissary purchase" means a transaction initiated by an inmate by which the
33     inmate obtains an item or items offered for sale by the correctional facility in exchange for
34     money withdrawn from the inmate's commissary account.
35          (c) "Correctional facility" means the same as that term is defined in Section
36     77-16b-102.
37          (d) "Inmate" means an individual in the custody of a correctional facility for criminal
38     charges or a criminal conviction.
39          (2) A correctional facility that employs a policy or practice by which the correctional
40     facility withdraws money from an inmate's commissary account, for any purpose other than a
41     commissary purchase, must disclose that policy or practice to the inmate or any other
42     individual seeking to make a deposit of money into the inmate's commissary account before the
43     correctional facility may accept and deposit the money into the inmate's commissary account.
