8 General Description:
9 This bill allows an institution of higher education to use automatic license plate reader
10 technology under certain circumstances.
11 Highlighted Provisions:
12 This bill:
13 ▸ allows an institution of higher education to use automatic license plate reader
14 technology if:
15 • the technology is used for traffic or parking related enforcement; or
16 • if the data collected remains anonymized, for research or educational purposes.

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 41-6a-2003 is amended to read:
27 41-6a-2003. Automatic license plate reader systems -- Restrictions.
28 (1) Except as provided in Subsection (2), a governmental entity may not use an
29 automatic license plate reader system.
30 (2) An automatic license plate reader system may be used:
31 (a) by a law enforcement agency for the purpose of protecting public safety, conducting
32 criminal investigations, or ensuring compliance with local, state, and federal laws;
33 (b) by a governmental parking enforcement entity for the purpose of enforcing state
34 and local parking laws;
35 (c) by a parking enforcement entity for regulating the use of a parking facility;
36 (d) for the purpose of controlling access to a secured area;
37 (e) for the purpose of collecting an electronic toll;
38 (f) for the purpose of enforcing motor carrier laws; [
39 (g) by a public transit district for the purpose of assessing parking needs and
40 conducting a travel pattern analysis[
41 (h) by an institution of higher education within the state system of higher education as
42 described in Section 53B-1-102:
43 (i) for a purpose described in Subsections (2)(a) through (d); or
44 (ii) if the data collected is anonymized, for research and educational purposes.
