8     LONG TITLE
9     General Description:
10          This joint resolution extends the approval of the negotiation of sales of portions of the
11     Winter Sports Park under certain conditions.
12     Highlighted Provisions:
13          This resolution:
14          ▸     extends the approval of the Utah Athletic Foundation's negotiation of sales of
15     portions of the Winter Sports Park under certain conditions.
16     Special Clauses:
17          None

19     Be it resolved by the Legislature of the state of Utah:
20          WHEREAS, as used in this resolution:
21          (1) "Foundation" means the Utah Athletic Foundation;
22          (2) "Sale," "sales," "sell," "sells," "selling," or "sold" means to transfer:
23          (a) ownership, title to, or possession of real property; and
24          (b) with or without consideration; and
25          (3) "Winter Sports Park" means the Foundation's winter sports park and access road
26     from State Highway 224 located in Summit County, Utah, consisting of certain real property
27     and all improvements thereon, including three separate venues, a nordic ski jump complex, a
28     freestyle aerial jump and pool complex, and a bobsled and luge track together with associated
29     facilities and all rights-of-way and other rights of ingress and egress that the Foundation owns;

30          WHEREAS, the state contributed in significant ways to the success of the Olympic
31     Winter Games of 2002, including building winter sports facilities used in hosting the Olympic
32     Winter Games of 2002;
33          WHEREAS, S.J.R. 17, Resolution Concerning Sale of Winter Sports Park and
34     Associated Facilities, 1994 General Session, and subsequent joint resolutions of the Legislature
35     govern the sale of the Winter Sports Park and payment of a Legacy Fund to the Foundation by
36     the Salt Lake Organizing Committee for the operation and maintenance of certain Olympic
37     venues operated by the Foundation;
38          WHEREAS, the citizens of Utah have an interest in the long-term financial and
39     operational success of the Foundation because of the importance of winter sports to the state
40     and because of the reversionary interest the state has in the Winter Sports Park under specified
41     circumstances;
42          WHEREAS, the Foundation believes that it has an obligation to the citizens of Utah to
43     find creative and responsible means to operate, maintain, and run winter sports programs and
44     related public activities long term at the Winter Sports Park;
45          WHEREAS, the Foundation desires to maintain and increase the amount of sport and
46     public activities at the Winter Sports Park, and the sales of portions of the Winter Sports Park
47     property would allow the Foundation to add complimentary development uses and reduce its
48     annual financial assistance from the Legacy Fund;
49          WHEREAS, the Foundation may have opportunities to sell portions of the Winter
50     Sports Park for real estate development;
51          WHEREAS, the Foundation believes that sales negotiated in accordance with relevant
52     joint resolutions will help improve the long-term viability of the Winter Sports Park;
53          WHEREAS, legislative approval was previously granted to the Foundation by S.J.R. 1,
54     Utah Athletic Foundation Resolution, 2007 General Session, to negotiate sales of any portion
55     of the Winter Sports Park for a limited time;
56          WHEREAS, the time frame to negotiate sales of any portion of the Winter Sports Park
57     was extended in S.J.R. 11, Utah Athletic Foundation Resolution, 2010 General Session, to

58     April 1, 2020;
59          WHEREAS, the sales of portions of the Winter Sports Park have proven beneficial to
60     the Foundation and as a consequence to the state; and
61          WHEREAS, legislative approval is required for the time period to be removed for the
62     Foundation to negotiate the sale of any portion of the Winter Sports Park:
63          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
64     approves the Foundation negotiating sales of portions of the property under the conditions set
65     forth in S.J.R. 1, Utah Athletic Foundation Resolution, 2007 General Session, except that the
66     time limitation is removed so that the Foundation may enter any negotiation, contract, or
67     agreement that would result in the Foundation selling a portion of the Winter Sports Park at
68     any time. The Legislature's approval terminates for any negotiation or sale occurring on and
69     after the day on which the Foundation fails to comply with this resolution in negotiating any
70     sale.
71          BE IT FURTHER RESOLVED that the Legislature of the state of Utah approves the
72     Foundation negotiating the sales of portions of the Winter Sports Park subject to the Governor
73     taking the actions required of the Governor in S.J.R. 1, Utah Athletic Foundation Resolution,
74     2007 General Session. The Legislature's approval terminates if the Governor chooses not to
75     take these actions required by S.J.R. 1, Utah Athletic Foundation Resolution, 2007 General
76     Session, in providing written approval and any other action required for real estate
77     development on the portion of the Winter Sports Park that is subject to negotiation for sale.
78          BE IT FURTHER RESOLVED that S.J.R. 17, Resolution Concerning Sale of Winter
79     Sports Park and Associated Facilities, 1994 General Session, and subsequent resolutions
80     relating to the Winter Sports Park and the Foundation remain in full force and effect except to
81     the extent that they are expressly superseded by this joint resolution.
82          BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Foundation.
