7 LONG TITLE
8 General Description:
9 This bill supplements or reduces appropriations otherwise provided for the support and
10 operation of state government for the fiscal year beginning July 1, 2019 and ending June 30, 2020
11 and for the fiscal year beginning July 1, 2020 and ending June 30, 2021.
12 Highlighted Provisions:
13 This bill:
14 ▸ provides budget increases and decreases for the use and support of certain state agencies;
15 ▸ provides budget increases and decreases for the use and support of certain public
16 education programs;
17 ▸ provides budget increases and decreases for the use and support of certain institutions of
18 higher education;
19 ▸ provides funds for the bills with fiscal impact passed in the 2020 General Session;
20 ▸ provides budget increases and decreases for other purposes as described;
21 ▸ provides a mathematical formula for the annual appropriations limit; and,
22 ▸ provides intent language.
23 Money Appropriated in this Bill:
24 This bill appropriates $24,663,100 in operating and capital budgets for fiscal year 2020,
25 including:
26 ▸ $5,324,000 from the General Fund;
27 ▸ ($3,000,000) from the Uniform School Fund;
28 ▸ $3,310,000 from the Education Fund; and
29 ▸ $19,029,100 from various sources as detailed in this bill.
30 This bill appropriates $9,756,300 in expendable funds and accounts for fiscal year 2020.
31 This bill appropriates ($4,403,300) in business-like activities for fiscal year 2020.
32 This bill appropriates $11,353,100 in restricted fund and account transfers for fiscal year
33 2020, including:
34 ▸ $723,100 from the General Fund; and
35 ▸ $10,630,000 from various sources as detailed in this bill.
36 This bill appropriates $12,943,600 in transfers to unrestricted funds for fiscal year 2020.
37 This bill appropriates $213,180,700 in operating and capital budgets for fiscal year 2021,
38 including:
39 ▸ ($13,403,600) from the General Fund;
40 ▸ ($7,000,000) from the Uniform School Fund;
41 ▸ $100,549,000 from the Education Fund; and
42 ▸ $133,035,300 from various sources as detailed in this bill.
43 This bill appropriates $10,744,200 in expendable funds and accounts for fiscal year 2021.
44 This bill appropriates ($458,800) in business-like activities for fiscal year 2021, including:
45 ▸ ($1,209,800) from the General Fund; and
46 ▸ $751,000 from various sources as detailed in this bill.
47 This bill appropriates $47,116,500 in restricted fund and account transfers for fiscal year
48 2021, including:
49 ▸ $19,088,200 from the General Fund;
50 ▸ $14,462,000 from the Education Fund; and
51 ▸ $13,566,300 from various sources as detailed in this bill.
52 This bill appropriates $88,000 in fiduciary funds for fiscal year 2021.
53 This bill appropriates $11,000,000 in capital project funds for fiscal year 2021, including:

55 ▸ ($23,500,000) from the Education Fund.
56 Other Special Clauses:
57 Section 1 of this bill takes effect immediately. Section 2 and Section 3 of this bill take effect
58 on July 1, 2020.

62 Be it enacted by the Legislature of the state of Utah:
63 Section 1. FY 2020 Appropriations. The following sums of money are appropriated for the
64 fiscal year beginning July 1, 2019 and ending June 30, 2020. These are additions to amounts
65 otherwise appropriated for fiscal year 2020.
66 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
67 Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of
68 money from the funds or accounts indicated for the use and support of the government of the state of
69 Utah.

170 Public Health Emergency Response shall not lapse at the close
171 of Fiscal Year 2020. The funding is to be used for the state's
172 response to coronavirus.

2630 Section 3. FY 2021 Appropriations Limit Formula.
2631 The state appropriations limit for a given fiscal year, FY, shall be calculated by
2632 , where:
2633 (a) ;
2634 (b) ;
2635 (c) ;
2636 (d) ; and
2637 (e) as used in the state appropriations limit formula:
2638 (i) i is a variable representing a given fiscal year;
2639 (ii) is the net adjustments to the state appropriations limit for a given fiscal year due
2640 to program or service adjustments, as required under Section 63J-3-203;
2641 (iii) is the state capital and operations appropriations from the General
2642 Fund and non-Uniform School fund in fiscal year 1985;
2643 (iv) is the amount the state paid in debt payments in fiscal year 1985;
2644 (v) is the average of the quarterly values of the Gross National Product
2645 Implicit Price Deflator for the fiscal year two fiscal years before FY, as published by the United
2646 States Federal Reserve by January 31 of each year;
2647 (vi) is the average of the quarterly values of the Gross National Product
2648 Implicit Price Deflator for a given fiscal year, as measured by the Gross National Product Implicit
2649 Price Deflator from the vintage series published by the United States Department of Commerce on
2650 January 26, 1990;
2651 (vii) is the change in the general price level of goods and services nationally
2652 from 1983 to two fiscal years before a given fiscal year, as measured by the most current Gross
2653 National Product Implicit Price Deflator series published by the United States Federal Reserve,
2654 adjusted to a 1989 basis;
2655 (viii) is the amount of real per capita state appropriations for fiscal
2656 year 1985; and
2657 (ix) is:
2658 (A) the population as of July 1 in the fiscal year two fiscal years before a given fiscal year,
2659 as estimated by the United States Census Bureau by January 31 of each year; or
2660 (B) if the estimate described in Subsection (3)(e)(ix)(A) is not available, an amount
2661 determined by the Governor's Office of Management and Budget, estimated by adjusting an
2662 available April 1 decennial census count or by adjusting a fiscal year population estimate available
2663 from the United States Census Bureau.
2664 Section 4. Effective Date.
2665 If approved by two-thirds of all the members elected to each house, Section 1 of this bill
2666 takes effect upon approval by the Governor, or the day following the constitutional time limit of
2667 Utah Constitution Article VII, Section 8 without the Governor's signature, or in the case of a veto,
2668 the date of override. Section 2 and Section 3 of this bill take effect on July 1, 2020.
