8     LONG TITLE
9     General Description:
10          This bill modifies provisions related to the Talent Ready Utah Center, which is part of
11     the Governor's Office of Economic Development.
12     Highlighted Provisions:
13          This bill:
14          ▸     defines terms;
15          ▸     provides that the Talent Ready Utah Center may award funding for apprenticeship
16     programs and work-based learning programs, subject to legislative appropriation;
17          ▸     describes the entities that may partner to submit a proposal for funding for an
18     apprentice program or work-based learning program;
19          ▸     describes the requirements for receiving funding for an apprentice program or
20     work-based learning program;
21          ▸     describes the Talent Ready Utah Center's duties and reporting requirements related
22     to administering funding for apprenticeship programs and work-based learning
23     programs; and
24          ▸     makes technical changes.
25     Money Appropriated in this Bill:
26          This bill appropriates in fiscal year 2021:
27          ▸     to the Governor's Office of Economic Development - Talent Ready Utah Center, as
28     an ongoing appropriation:
29               •     from the Education Fund, $2,000,000.

37     Be it enacted by the Legislature of the state of Utah:
38          Section 1. Section 63N-12-501 is amended to read:

CHAPTER 12. PROFESSIONAL AND TECHNICAL WORKFORCE

DEVELOPMENT PROGRAMS

41          63N-12-501. Definitions.
42          As used in this part:
43          (1) "Apprenticeship program" means a program that combines paid on-the-job learning
44     with formal classroom instruction to prepare students for careers and that includes:
45          (a) structured on-the-job learning for students under the supervision of a skilled
46     employee;
47          (b) classroom instruction for students related to the on-the-job learning;
48          (c) ongoing student assessments using established competency and skills standards;
49     and
50          (d) the student receiving an industry-recognized credential or degree upon completion
51     of the program.
52          (2) "Career and technical education region" means an economic service area created in
53     Section 35A-2-101.
54          [(1)] (3) "Center" means the Talent Ready Utah Center created in Section 63N-12-502.
55          [(2)] (4) "High quality professional learning" means the professional learning standards
56     for teachers and principals described in Section 53G-11-303.
57          (5) "Institution of higher education" means the University of Utah, Utah State
58     University, Southern Utah University, Weber State University, Snow College, Dixie State
59     University, Utah Valley University, or Salt Lake Community College.
60          [(3)] (6) "Local education agency" means a school district, a charter school, or the Utah
61     Schools for the Deaf and the Blind.
62          [(4)] (7) "Master plan" means the computer science education master plan described in
63     Section 63N-12-505.
64          (8) "Participating employer" means an employer that:
65          (a) partners with an educational institution on a curriculum for an apprenticeship
66     program or work-based learning program; and
67          (b) provides an apprenticeship or work-based learning program for students.
68          (9) "Stackable credentials" means a sequence of credentials that:
69          (a) can be accumulated over time to build up an individual's qualifications for a better
70     job or higher wage;
71          (b) are part of a career pathway system; and
72          (c) provide the option of culminating in an associate or bachelor's degree.
73          [(5)] (10) "State board" means the State Board of Education.
74          [(6)] (11) "Talent ready board" means the Talent Ready Utah Board created in Section
75     63N-12-503.
76          (12) "Technical college" means:
77          (a) a technical college described in Section 53B-2a-105;
78          (b) the School of Applied Technology at Salt Lake Community College established in
79     Section 53B-16-209;
80          (c) Utah State University Eastern established in Section 53B-18-1201;
81          (d) Utah State University Blanding established in Section 53B-18-1202; or
82          (e) the Snow College Richfield campus established in Section 53B-16-205.
83          (13) (a) "Work-based learning program" means a program that combines structured and
84     supervised learning activities with authentic work experiences and that is implemented through
85     industry and education partnerships.
86          (b) "Work-based learning program" includes the following objectives:
87          (i) providing students an applied workplace experience using knowledge and skills
88     attained in a program of study that includes an internship, externship, or work experience;
89          (ii) providing an educational institution with objective input from a participating
90     employer regarding the education requirements of the current workforce; and
91          (iii) providing funding for programs that are associated with high-wage, in-demand, or
92     emerging occupations.
93          [(7)] (14) "Workforce programs" means education or industry programs that facilitate
94     training the state's workforce to meet industry demand.
95          Section 2. Section 63N-12-507 is amended to read:
96          63N-12-507. Apprenticeships and work-based learning.
97          [(1) The center in collaboration with the talent ready board shall partner with private
98     businesses and the State Board of Education to create a pilot program for apprenticeships that
99     begin in grade 11 and grade 12.]
100          [(2) The elements of an apprentice program described in this part may include:]
101          [(a) partnering with private businesses to offer apprentice positions to high school
102     students;]
103          [(b) the center soliciting participation from businesses in various sectors, such as
104     advanced manufacturing, information technology, financial services, business operations, and
105     health care;]
106          [(c) the center in partnership with the State Board of Education soliciting the
107     participation of local education agencies and students;]
108          [(d) students selected for apprentice positions spending part of the students' week
109     learning at school and part of the week learning at a job with a private business;]
110          [(e) the center in partnership with the State Board of Education collaborating with
111     private businesses to ensure that offered apprenticeships provide career competencies and
112     stackable credentials so that the skills apprentices are developing prepare them for the job
113     market;]
114          [(f) the center in partnership with the State Board of Education ensuring that
115     apprenticeship training meets competency-based standards described in Section 53E-4-204,
116     such that the apprentices can graduate from high school in the traditional amount of time;]
117          [(g) the center in partnership with the State Board of Education ensuring that students
118     participating in an apprentice program as described in this section are counted as full-day
119     equivalent pupils of the local education agency the student attends for purposes of state
120     funding;]
121          [(h) the center providing an intermediary role between the systems of business and
122     education, recruiting students for apprenticeships, and ensuring apprentice work and school
123     schedules are optimized;]
124          [(i) participating private businesses:]
125          [(i) paying wages, providing meaningful work experience, and providing
126     nationally-recognized certifications to apprentices; and]
127          [(ii) offering full-time positions or subsidized higher education opportunities to
128     apprentices after successful completion of apprenticeships; and]
129          [(j) researching and implementing innovations and best practices from other
130     jurisdictions.]
131          (1) The center in collaboration with the talent ready board may partner with one or
132     more of the following to facilitate and encourage apprenticeship opportunities and work-based
133     learning opportunities for Utah students:
134          (a) the state board;
135          (b) the Utah System of Technical Colleges;
136          (c) the Utah System of Higher Education; and
137          (d) a participating employer in the state.
138          (2) Subject to appropriations from the Legislature and in accordance with the proposal
139     process and other provisions of this section, the talent ready board, with the concurrence of the
140     executive director, may provide funding for approved apprenticeship opportunities and
141     work-based learning opportunities.
142          (3) To receive funding under this section, an entity described in Subsection (1) seeking
143     to partner with the center shall submit a proposal through the center, in a form approved by the
144     center and in accordance with deadlines determined by the center, that contains the following
145     elements:
146          (a) the proposal shall include:
147          (i) a description of the proposed apprenticeship program or work-based learning
148     program that demonstrates the program will be:
149          (A) responsive to the workforce needs of a high demand industry or occupation; and
150          (B) a partnership between at least one participating employer and at least one public
151     high school, technical college, or institution of higher education;
152          (ii) an estimate of:
153          (A) student enrollment in the program;
154          (B) what school credit, credentials, certifications, or other workforce attainments will
155     be provided by the program; and
156          (C) job-placement rates for students who complete the program;
157          (iii) evidence that each participating employer is committed to:
158          (A) participating and contributing to the program; and
159          (B) paying wages to students participating in the program;
160          (iv) a description of any financial contributions or in-kind contributions that will be
161     provided by each participating employer in the program;
162          (v) if the program would require state board approval under the provisions of Section
163     53B-16-102, evidence that the state board has approved the program; and
164          (vi) the amount of funding requested for the program, including justification for the
165     funding; and
166          (b) while not required, a preference may be given to a proposal that includes:
167          (i) a description of a stackable credentialing pathway for participating students that will
168     be created by the program between at least two of the following:
169          (A) a public high school;
170          (B) a technical college; and
171          (C) an institution of higher education; or
172          (ii) the potential for participating students to obtain full-time employment with the
173     participating employer upon completion of the program.
174          (4) The talent ready board shall review and prioritize each proposal received and
175     determine whether the proposal should be funded, using the following criteria:
176          (a) the quality and completeness of the elements of the proposal described in
177     Subsection (3)(a);
178          (b) the quality of the optional elements of the proposal described in Subsection (3)(b);
179          (c) to what extent the proposal would expand the capacity to meet state or regional
180     workforce needs; and
181          (d) other relevant criteria as determined by the talent ready board.
182          (5) A partnership that receives funding under this section:
183          (a) shall use the money to accomplish the proposed apprenticeship program or
184     work-based learning program;
185          (b) may use the money to offset a participating employer's direct operational costs
186     associated with employing students as part of an approved apprenticeship program or
187     work-based learning program;
188          (c) except as provided in Subsection (5)(d), may not use the money for educational
189     administration; and
190          (d) may use the money to support one full-time employee within a career and technical
191     education region if:
192          (i) each participating local education agency, public high school, technical college, and
193     institution of higher education agree on which entity will house the full-time employee;
194          (ii) the full-time employee spends all of the employee's time working exclusively to
195     develop apprentice programs or work-based learning programs; and
196          (iii) the full-time employee is responsible for regular reporting to and receiving training
197     from the director of the center.
198          (6) The center shall be responsible for the administration of apprenticeship programs
199     and work-based learning programs described in this section, including:
200          (a) working with and providing technical assistance to the participating partners that
201     establish apprentice programs and work-based learning programs and that receive funding
202     under the provisions of this section;
203          (b) establishing reporting requirements for participating partners that establish
204     apprentice programs and work-based learning programs and that receive funding under the
205     provisions of this section;
206          (c) providing outreach and marketing to encourage more employers to participate; and
207          (d) annually providing information to GOED regarding the activities, successes, and
208     challenges of the center related to administering apprentice programs and work-based learning
209     programs for inclusion in GOED's annual written report described in Section 63N-1-301,
210     including:
211          (i) specific entities that received funding under this section;
212          (ii) the amount of funding provided to each entity; and
213          (iii) the number of participating students in each apprentice program and work-based
214     learning program.
215          (7) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, and
216     the provisions of this section, the center may make rules regarding:
217          (a) the method and deadlines for applying for funding under this section;
218          (b) the distribution of funding under this section; and
219          (c) the reporting requirements of each entity receiving funding under this section.
220          Section 3. Appropriation.
221          The following sums of money are appropriated for the fiscal year beginning July 1,
222     2020, and ending June 30, 2021. These are additions to amounts previously appropriated for
223     fiscal year 2021. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
224     Act, the Legislature appropriates the following sums of money from the funds or accounts
225     indicated for the use and support of the government of the state of Utah.

231          The Legislature intends that:
232          (1) the Talent Ready Utah Center expend appropriations under this item to implement
233     the educational purposes of the apprenticeship and work-based learning opportunities program
234     described in Section 63N-12-507;
235          (2) under Section 63J-1-603, appropriations provided by this item not lapse at the close
236     of fiscal year 2021; and
237          (3) the Governor's Office of Economic Development and the Talent Ready Utah Center
238     may not use money from this appropriation to pay for administrative support provided by the
239     Governor's Office of Economic Development or the Talent Ready Utah Center related to the
240     apprenticeship and work-based learning opportunities program described in Section
241     63N-12-507.
