7     LONG TITLE
8     General Description:
9          This bill amends provisions relating to exemptions from jury service.
10     Highlighted Provisions:
11          This bill:
12          ▸     provides that an individual who is 72 years old or older may be excused from jury
13     service; and
14          ▸     makes technical and conforming changes.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 78B-1-108 is amended to read:
26          78B-1-108. Qualified prospective jurors not exempt from jury service.
27          [No] Except as provided in Subsection 78B-1-109(2), no qualified prospective juror is
28     exempt from jury service.
29          Section 2. Section 78B-1-109 is amended to read:
30          78B-1-109. Excuse from jury service -- Postponement.
31          (1) (a) A court may excuse an individual from jury service:
32          [(a)] (i) upon a showing:
33          [(i)] (A) of undue hardship;
34          [(ii)] (B) of public necessity;
35          [(iii)] (C) that the individual is a mother who is breastfeeding a child; or
36          [(iv)] (D) that the individual is incapable of jury service; and
37          [(b)] (ii) for any period for which the grounds described in Subsection (1)(a) exist.
38          [(2)] (b) An individual described in Subsection (1)(a) shall make the showing
39     described in Subsection (1)(a) by affidavit, sworn testimony, or other competent evidence.
40          [(3)] (c) The court may postpone jury service upon a showing of good cause.
41          (2) A court shall excuse an individual from jury service if the individual is 72 years old
42     or older and the individual requests to be excused from service.
