7     LONG TITLE
8     General Description:
9          This bill enacts provisions related to uninsured and underinsured motorist coverage for
10     farm equipment.
11     Highlighted Provisions:
12          This bill:
13          ▸     defines terms;
14          ▸     enacts provisions allowing an insurance carrier to offer uninsured and underinsured
15     motorist coverage for farm equipment being operated on a public highway; and
16          ▸     requires certain minimum coverage limits for uninsured and underinsured motorist
17     coverage for farm equipment.

20     Other Special Clauses:
21          This bill provides a special effective date.

26     Be it enacted by the Legislature of the state of Utah:
27          Section 1. Section 32A-22-1302.1 is enacted to read:
28          32A-22-1302.1. Uninsured and underinsured motorist coverage for farm
29     equipment on a public roadway.
30          (1) As used in this section:
31          (a) "Farm equipment" means a tractor, bulldozer, forklift, or other mobile equipment
32     used for cultivating and harvesting designed for use principally off public roads and not subject
33     to the insurance requirements in Section 31A-22-302.
34          (b) "Underinsured motorist coverage" means the same as that term is described in
35     Section 31A-22-305.3.
36          (c) "Uninsured motorist coverage" means the same as that term is described in Section
37     31A-22-305.
38          (2) An insurance carrier offering farm liability coverage in this state may offer an
39     optional endorsement for an additional premium to provide for uninsured motorist coverage or
40     underinsured motorist coverage for individuals operating farm equipment on a public roadway.
41          (3) The coverage offered in the endorsement described in Subsection (2) shall meet the
42     minimum limits specified in Sections 31A-22-305 and 31A-22-305.3.
43          (4) The farm liability insurer may offer higher optional limits than those specified in
44     Subsection (3).
45          Section 2. Effective date.
46          This bill takes effect on January 1, 2021.
