8 General Description:
9 This bill revises provisions in the Uniform Driver License Act.
10 Highlighted Provisions:
11 This bill:
12 ▸ requires the Driver License Division of the Department of Public Safety, upon
13 request from an individual and subject to certain written verification, to include an
14 identifying sticker on the individual's driver license or identification card to indicate
15 that the individual is an individual with a disability; and
16 ▸ makes technical changes.

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 46-1-2 is amended to read:
30 46-1-2. Definitions.
31 As used in this chapter:
32 (1) "Acknowledgment" means a notarial act in which a notary certifies that a signer,
33 whose identity is personally known to the notary or proven on the basis of satisfactory
34 evidence, has admitted, in the presence of the notary, to voluntarily signing a document for the
35 document's stated purpose.
36 (2) "Before me" means that an individual appears in the presence of the notary.
37 (3) "Commission" means:
38 (a) to empower to perform notarial acts; or
39 (b) the written document that gives authority to perform notarial acts, including the
40 Certificate of Authority of Notary Public that the lieutenant governor issues to a notary.
41 (4) "Copy certification" means a notarial act in which a notary certifies that a
42 photocopy is an accurate copy of a document that is neither a public record nor publicly
43 recorded.
44 (5) "Electronic recording" means the audio and video recording, described in
45 Subsection 46-1-3.6(3), of a remote notarization.
46 (6) "Electronic seal" means an electronic version of the seal described in Section
47 46-1-16, that conforms with rules made under Subsection 46-1-3.7(1)(d), that a remote notary
48 may attach to a notarial certificate to complete a remote notarization.
49 (7) "Electronic signature" means the same as that term is defined in Section 46-4-102.
50 (8) "In the presence of the notary" means that an individual:
51 (a) is physically present with the notary in close enough proximity to see and hear the
52 notary; or
53 (b) communicates with a remote notary by means of an electronic device or process
54 that:
55 (i) allows the individual and remote notary to communicate with one another
56 simultaneously by sight and sound; and
57 (ii) complies with rules made under Section 46-1-3.7.
58 (9) "Jurat" means a notarial act in which a notary certifies:
59 (a) the identity of a signer who:
60 (i) is personally known to the notary; or
61 (ii) provides the notary satisfactory evidence of the signer's identity;
62 (b) that the signer affirms or swears an oath attesting to the truthfulness of a document;
63 and
64 (c) that the signer voluntarily signs the document in the presence of the notary.
65 (10) "Notarial act" or "notarization" means an act that a notary is authorized to perform
66 under Section 46-1-6.
67 (11) "Notarial certificate" means the affidavit described in Section 46-1-6.5 that is:
68 (a) a part of or attached to a notarized document; and
69 (b) completed by the notary and bears the notary's signature and official seal.
70 (12) (a) "Notary" means an individual commissioned to perform notarial acts under this
71 chapter.
72 (b) "Notary" includes a remote notary.
73 (13) "Oath" or "affirmation" means a notarial act in which a notary certifies that a
74 person made a vow or affirmation in the presence of the notary on penalty of perjury.
75 (14) "Official misconduct" means a notary's performance of any act prohibited or
76 failure to perform any act mandated by this chapter or by any other law in connection with a
77 notarial act.
78 (15) (a) "Official seal" means the seal described in Section 46-1-16 that a notary may
79 attach to a notarial certificate to complete a notarization.
80 (b) "Official seal" includes an electronic seal.
81 (16) "Personally known" means familiarity with an individual resulting from
82 interactions with that individual over a period of time sufficient to eliminate every reasonable
83 doubt that the individual has the identity claimed.
84 (17) "Remote notarization" means a notarial act performed by a remote notary in
85 accordance with this chapter for an individual who is not in the physical presence of the remote
86 notary at the time the remote notary performs the notarial act.
87 (18) "Remote notary" means a notary that holds an active remote notary certification
88 under Section 46-1-3.5.
89 (19) (a) "Satisfactory evidence of identity" means:
90 (i) for both an in-person and remote notarization, identification of an individual based
91 on:
92 (A) subject to Subsection (19)(b), valid personal identification with the individual's
93 photograph, signature, and physical description that the United States government, any state
94 within the United States, or a foreign government issues;
95 (B) subject to Subsection (19)(b), a valid passport that any nation issues; or
96 (C) the oath or affirmation of a credible person who is personally known to the notary
97 and who personally knows the individual; and
98 (ii) for a remote notarization only, a third party's affirmation of an individual's identity
99 in accordance with rules made under Section 46-1-3.7 by means of:
100 (A) dynamic knowledge-based authentication, which may include requiring the
101 individual to answer questions about the individual's personal information obtained from
102 public or proprietary data sources; or
103 (B) analysis of the individual's biometric data, which may include facial recognition,
104 voiceprint analysis, or fingerprint analysis.
105 (b) "Satisfactory evidence of identity," for a remote notarization, requires the
106 identification described in Subsection (19)(a)(i)(A) or passport described in Subsection
107 (19)(a)(i)(B) to be verified through public or proprietary data sources in accordance with rules
108 made under Section 46-1-3.7.
109 (c) "Satisfactory evidence of identity" does not include:
110 (i) a driving privilege card under Subsection 53-3-207[
111 (ii) another document that is not considered valid for identification.
112 (20) "Signature witnessing" means a notarial act in which an individual:
113 (a) appears in the presence of the notary and presents a document;
114 (b) provides the notary satisfactory evidence of the individual's identity, or is
115 personally known to the notary; and
116 (c) signs the document in the presence of the notary.
117 Section 2. Section 53-3-207 (Superseded 07/01/20) is amended to read:
118 53-3-207 (Superseded 07/01/20). License certificates or driving privilege cards
119 issued to drivers by class of motor vehicle -- Contents -- Release of anatomical gift
120 information -- Temporary licenses or driving privilege cards -- Minors' licenses, cards,
121 and permits -- Violation.
122 (1) As used in this section:
123 (a) "Driving privilege" means the privilege granted under this chapter to drive a motor
124 vehicle.
125 (b) "Governmental entity" means the state and its political subdivisions as defined in
126 this Subsection (1).
127 (c) "Political subdivision" means any county, city, town, school district, public transit
128 district, community reinvestment agency, special improvement or taxing district, local district,
129 special service district, an entity created by an interlocal agreement adopted under Title 11,
130 Chapter 13, Interlocal Cooperation Act, or other governmental subdivision or public
131 corporation.
132 (d) "State" means this state, and includes any office, department, agency, authority,
133 commission, board, institution, hospital, college, university, children's justice center, or other
134 instrumentality of the state.
135 (2) (a) The division shall issue to every person privileged to drive a motor vehicle, a
136 regular license certificate, a limited-term license certificate, or a driving privilege card
137 indicating the type or class of motor vehicle the person may drive.
138 (b) A person may not drive a class of motor vehicle unless granted the privilege in that
139 class.
140 (3) (a) Every regular license certificate, limited-term license certificate, or driving
141 privilege card shall bear:
142 (i) the distinguishing number assigned to the person by the division;
143 (ii) the name, birth date, and Utah residence address of the person;
144 (iii) a brief description of the person for the purpose of identification;
145 (iv) any restrictions imposed on the license under Section 53-3-208;
146 (v) a photograph of the person;
147 (vi) a photograph or other facsimile of the person's signature;
148 (vii) an indication whether the person intends to make an anatomical gift under Title
149 26, Chapter 28, Revised Uniform Anatomical Gift Act, unless the driving privilege is extended
150 under Subsection 53-3-214(3); and
151 (viii) except as provided in Subsection (3)(b), if the person states that the person is a
152 veteran of the United States military on the application for a driver license in accordance with
153 Section 53-3-205 and provides verification that the person was granted an honorable or general
154 discharge from the United States Armed Forces, an indication that the person is a United States
155 military veteran for a regular license certificate or limited-term license certificate issued on or
156 after July 1, 2011.
157 (b) A regular license certificate or limited-term license certificate issued to any person
158 younger than 21 years on a portrait-style format as required in Subsection [
159 required to include an indication that the person is a United States military veteran under
160 Subsection (3)(a)(viii).
161 (c) A new license certificate issued by the division may not bear the person's Social
162 Security number.
163 (d) (i) The regular license certificate, limited-term license certificate, or driving
164 privilege card shall be of an impervious material, resistant to wear, damage, and alteration.
165 (ii) Except as provided under Subsection [
166 regular license certificate, limited-term license certificate, or driving privilege card shall be as
167 prescribed by the commissioner.
168 (iii) The commissioner may also prescribe the issuance of a special type of limited
169 regular license certificate, limited-term license certificate, or driving privilege card under
170 Subsection 53-3-220(4).
171 (4) (a) As used in this Subsection (4), "disability" means a physical or mental
172 disability, as defined and covered by the Americans with Disabilities Act of 1990, 42 U.S.C.
173 Sec. 12102.
174 (b) At the applicant's request, the division shall include an identifying sticker on the
175 regular license certificate, limited-term license certificate, or driving privilege card to indicate
176 that the applicant is an individual with a disability, if the applicant provides written verification
177 that the applicant is an individual with a disability.
178 (c) The written verification described in Subsection (4)(b) shall be made on a form
179 provided by the division.
180 (d) The division may not:
181 (i) charge a fee to include the disability identifying sticker described in Subsection
182 (4)(b) on the applicant's regular license certificate, limited-term license certificate, or driving
183 privilege card; or
184 (ii) require the applicant to provide subsequent written verification that the applicant is
185 an individual with a disability for including the disability identifying sticker on the applicant's
186 renewed or extended regular license certificate, limited-term license certificate, or driving
187 privilege card, after including the disability identifying sticker on the applicant's previously
188 issued regular license certificate, limited-term license certificate, or driving privilege card in
189 accordance with Subsection (4)(b).
190 (e) The inclusion of a disability identifying sticker on an individual's regular license
191 certificate, limited-term license certificate, or driving privilege card in accordance with
192 Subsection (4)(b) does not confer any legal rights or privileges on the individual, including
193 parking privileges for individuals with disabilities under Section 41-1a-414.

195 mentally and physically qualified to be granted a driving privilege, may issue to an applicant a
196 receipt for the fee if the applicant is eligible for a regular license certificate or limited-term
197 license certificate.
198 (ii) (A) The division shall issue a temporary regular license certificate or temporary
199 limited-term license certificate allowing the person to drive a motor vehicle while the division
200 is completing its investigation to determine whether the person is entitled to be granted a
201 driving privilege.
202 (B) A temporary regular license certificate or a temporary limited-term license
203 certificate issued under this Subsection [
204 and privileges as a regular license certificate or a limited-term license certificate.
205 (b) The temporary regular license certificate or temporary limited-term license
206 certificate shall be in the person's immediate possession while driving a motor vehicle, and it is
207 invalid when the person's regular license certificate or limited-term license certificate has been
208 issued or when, for good cause, the privilege has been refused.
209 (c) The division shall indicate on the temporary regular license certificate or temporary
210 limited-term license certificate a date after which it is not valid as a temporary license.
211 (d) (i) Except as provided in Subsection [
212 temporary driving privilege card or other temporary permit to an applicant for a driving
213 privilege card.
214 (ii) The division may issue a learner permit issued in accordance with Section
215 53-3-210.5 to an applicant for a driving privilege card.

217 license certificates, limited-term license certificates, and driving privilege cards issued to any
218 person younger than 21 years of age by use of plainly printed information or the use of a color
219 or other means not used for other regular license certificates, limited-term license certificates,
220 or driving privilege cards.
221 (b) The division shall distinguish a regular license certificate, limited-term license
222 certificate, or driving privilege card issued to any person:
223 (i) younger than 21 years of age by use of a portrait-style format not used for other
224 regular license certificates, limited-term license certificates, or driving privilege cards and by
225 plainly printing the date the regular license certificate, limited-term license certificate, or
226 driving privilege card holder is 21 years of age, which is the legal age for purchasing an
227 alcoholic beverage or alcoholic product under Section 32B-4-403; and
228 (ii) younger than 19 years of age, by plainly printing the date the regular license
229 certificate, limited-term license certificate, or driving privilege card holder is 19 years of age,
230 which is the legal age for purchasing tobacco products under Section 76-10-104.

233 (a) that it is temporary; and
234 (b) its expiration date.

238 (b) The division shall distinguish a driving privilege card from a license certificate by:
239 (i) use of a format, color, font, or other means; and
240 (ii) clearly displaying on the front of the driving privilege card a phrase substantially
241 similar to "FOR DRIVING PRIVILEGES ONLY -- NOT VALID FOR IDENTIFICATION".

259 Section 3. Section 53-3-207 (Effective 07/01/20) is amended to read:
260 53-3-207 (Effective 07/01/20). License certificates or driving privilege cards
261 issued to drivers by class of motor vehicle -- Contents -- Release of anatomical gift
262 information -- Temporary licenses or driving privilege cards -- Minors' licenses, cards,
263 and permits -- Violation.
264 (1) As used in this section:
265 (a) "Driving privilege" means the privilege granted under this chapter to drive a motor
266 vehicle.
267 (b) "Governmental entity" means the state or a political subdivision of the state.
268 (c) "Political subdivision" means any county, city, town, school district, public transit
269 district, community reinvestment agency, special improvement or taxing district, local district,
270 special service district, an entity created by an interlocal agreement adopted under Title 11,

279 (b) An individual may not drive a class of motor vehicle unless granted the privilege in
280 that class.
281 (3) (a) Every regular license certificate, limited-term license certificate, or driving
282 privilege card shall bear:
283 (i) the distinguishing number assigned to the individual by the division;
284 (ii) the name, birth date, and Utah residence address of the individual;
285 (iii) a brief description of the individual for the purpose of identification;
286 (iv) any restrictions imposed on the license under Section 53-3-208;
287 (v) a photograph of the individual;
288 (vi) a photograph or other facsimile of the person's signature;
289 (vii) an indication whether the individual intends to make an anatomical gift under
290 Title 26, Chapter 28, Revised Uniform Anatomical Gift Act, unless the driving privilege is
291 extended under Subsection 53-3-214(3); and
292 (viii) except as provided in Subsection (3)(b), if the individual states that the individual
293 is a veteran of the United States military on the application for a driver license in accordance
294 with Section 53-3-205 and provides verification that the individual was granted an honorable
295 or general discharge from the United States Armed Forces, an indication that the individual is a
296 United States military veteran for a regular license certificate or limited-term license certificate
297 issued on or after July 1, 2011.
298 (b) A regular license certificate or limited-term license certificate issued to an
299 individual younger than 21 years on a portrait-style format as required in Subsection [
300 (6)(b) is not required to include an indication that the individual is a United States military
301 veteran under Subsection (3)(a)(viii).
302 (c) A new license certificate issued by the division may not bear the individual's social
303 security number.
304 (d) (i) The regular license certificate, limited-term license certificate, or driving
305 privilege card shall be of an impervious material, resistant to wear, damage, and alteration.
306 (ii) Except as provided under Subsection [
307 regular license certificate, limited-term license certificate, or driving privilege card shall be as
308 prescribed by the commissioner.
309 (iii) The commissioner may also prescribe the issuance of a special type of limited

329 issued regular license certificate, limited-term license certificate, or driving privilege card in
330 accordance with Subsection (4)(b).
331 (e) The inclusion of a disability identifying sticker on an individual's regular license
332 certificate, limited-term license certificate, or driving privilege card in accordance with
333 Subsection (4)(b) does not confer any legal rights or privileges on the individual, including
334 parking privileges for individuals with disabilities under Section 41-1a-414.

395 Section 4. Section 53-3-805 is amended to read:
396 53-3-805. Identification card -- Contents -- Specifications.
397 (1) (a) The division shall issue an identification card that bears:
398 (i) the distinguishing number assigned to the [
399 (ii) the name, birth date, and Utah residence address of the [
400 (iii) a brief description of the [
401 (iv) a photograph of the [
402 (v) a photograph or other facsimile of the [
403 (vi) an indication whether the [
404 under Title 26, Chapter 28, Revised Uniform Anatomical Gift Act; and
405 (vii) if the [
406 United States military on the application for an identification card in accordance with Section
407 53-3-804 and provides verification that the [
408 general discharge from the United States Armed Forces, an indication that the [
409 individual is a United States military veteran for a regular identification card or a limited-term
410 identification card issued on or after July 1, 2011.
411 (b) An identification card issued by the division may not bear the [
412 individual's Social Security number or place of birth.
413 (2) (a) The card shall be of an impervious material, resistant to wear, damage, and
414 alteration.
415 (b) Except as provided under Section 53-3-806, the size, form, and color of the card is
416 prescribed by the commissioner.
417 (3) At the applicant's request, the card may include a statement that the applicant has a
418 special medical problem or allergies to certain drugs, for the purpose of medical treatment.
419 (4) (a) As used in this Subsection (4), "disability" means the same as that term is
420 defined in Subsection 53-3-207(4).
421 (b) At the applicant's request, the division shall include an identifying sticker on the
422 identification card to indicate that the applicant is an individual with a disability, if the
423 applicant provides written verification that the applicant is an individual with a disability.
424 (c) The written verification described in Subsection (4)(b) shall be made on a form
425 provided by the division.
426 (d) The division may not:
427 (i) charge a fee to include the disability identifying sticker described in Subsection
428 (4)(b) on the applicant's identification card; or
429 (ii) require the applicant to provide subsequent written verification that the applicant is
430 an individual with a disability for including the disability identifying sticker on the applicant's
431 extended identification card, after including the disability identifying sticker on the applicant's
432 previously issued identification card in accordance with Subsection (4)(b).
433 (e) The inclusion of a disability identifying sticker on an individual's identification card
434 in accordance with Subsection (4)(b) does not confer any legal rights or privileges on the
435 individual, including parking privileges for individuals with disabilities under Section
436 41-1a-414.

439 (b) (i) Notwithstanding Title 63G, Chapter 2, Government Records Access and
440 Management Act, the division may, upon request, release to an organ procurement
441 organization, as defined in Section 26-28-102, the names and addresses of all [
442 individuals who under Subsection 53-3-804(2)(j) indicate that they intend to make an
443 anatomical gift.
444 (ii) An organ procurement organization may use released information only to:
445 (A) obtain additional information for an anatomical gift registry; and
446 (B) inform applicants of anatomical gift options, procedures, and benefits.

463 (c) A temporary regular identification card issued under this Subsection [
464 invalid:
465 (i) when the [
466 (ii) when, for good cause, an applicant's application for a regular identification card has
467 been refused; or
468 (iii) upon expiration of the temporary regular identification card.
469 Section 5. Effective date.
470 This bill takes effect on May 12, 2020, except that the amendments to Section 53-3-207
471 (Effective 07/01/20) take effect on July 1, 2020.
