7     LONG TITLE
8     General Description:
9          This bill requires the owner of an extraterritorial airport located in a county of the first
10     class to transfer ownership and operation of the airport to the municipality in which the
11     airport is located if certain requirements are met.
12     Highlighted Provisions:
13          This bill:
14          ▸     requires the owner of an extraterritorial airport located in a county of the first class
15     to transfer ownership and operation of the airport to the municipality in which the
16     airport is located if:
17               •     the owner of the extraterritorial airport offers to transfer the extraterritorial
18     airport;
19               •     the municipality in which the extraterritorial airport is located accepts the
20     transfer; and
21               •     the municipality receives approval from the Federal Aviation Administration as
22     eligible to sponsor and operate the airport; and
23          ▸     allows the owner of the extraterritorial airport to transfer the extraterritorial airport
24     below market value to the municipality in which the extraterritorial airport is
25     located.

34     Be it enacted by the Legislature of the state of Utah:
35          Section 1. Section 72-10-203.1 is enacted to read:
36          72-10-203.1. Transfer of extraterritorial airports.
37          (1) For purposes of this section:
38          (a) "Airport owner" means the municipality, county, or airport authority that owns one
39     or more airports.
40          (b) "Extraterritorial airport" means an airport, including the airport facilities, real
41     estate, or other assets related to the operation of an airport, outside the municipality or county
42     and within the boundary of a different municipality or county.
43          (2) For an extraterritorial airport located in a municipality in a county of the first class,
44     the airport owner of the extraterritorial airport shall transfer ownership and operation of the
45     extraterritorial airport to the municipality in which the extraterritorial airport is located, if:
46          (a) the airport owner of the extraterritorial airport offers to transfer the extraterritorial
47     airport;
48          (b) the municipality in which the extraterritorial airport is located agrees to the transfer;
49     and
50          (c) the municipality in which the extraterritorial airport is located has received approval
51     from the Federal Aviation Administration as an eligible airport sponsor and operator.
52          (3) For a transfer of an airport described in Subsection (2), the airport owner of an
53     extraterritorial airport may transfer the extraterritorial airport below market value to the
54     recipient municipality.
