7     LONG TITLE
8     General Description:
9          This bill amends the definition of a student who is eligible for concurrent enrollment.
10     Highlighted Provisions:
11          This bill:
12          ▸     includes a student who is enrolled in a course through the statewide online
13     education program in the definition of an eligible student for purposes of concurrent
14     enrollment.

23     Be it enacted by the Legislature of the state of Utah:
24          Section 1. Section 53E-10-301 is amended to read:
25          53E-10-301. Definitions.

26          As used in this part:
27          (1) "Career and technical education course" means a concurrent enrollment course in
28     career and technical education, as determined by the policy established by the State Board of
29     Regents under Section 53E-10-302.
30          (2) "Concurrent enrollment" means enrollment in a course offered through the
31     concurrent enrollment program described in Section 53E-10-302.
32          (3) "Educator" means the same as that term is defined in Section 53E-6-102.
33          (4) "Eligible instructor" means an instructor who meets the requirements described in
34     Subsection 53E-10-302(5).
35          (5) (a) "Eligible student" means a student who:
36          [(a)] (i) is enrolled in, and counted in average daily membership in, a public school
37     within the state;
38          [(b)] (ii) has on file a plan for college and career readiness as described in Section
39     53E-2-304; and
40          [(c)] (iii) is in grade 9, 10, 11, or 12.
41          (b) "Eligible student" includes a student described in Subsection (5)(a) who is enrolled
42     in a course through the statewide online education program created in Section 53F-4-502.
43          (6) "Institution of higher education" means an institution that is part of the Utah
44     System of Higher Education described in Subsection 53B-1-102(1)(a).
45          (7) "License" means the same as that term is defined in Section 53E-6-102.
46          (8) "Local education agency" or "LEA" means a school district or charter school.
47          (9) "Qualifying experience" means an LEA employee's experience in an academic field
48     that:
49          (a) qualifies the LEA employee to teach a concurrent enrollment course in the
50     academic field; and
51          (b) may include the LEA employee's:
52          (i) number of years teaching in the academic field;
53          (ii) holding a higher level secondary teaching credential issued by the state board;
54          (iii) research, publications, or other scholarly work in the academic field;
55          (iv) continuing professional education in the academic field;
56          (v) portfolio of work related to the academic field; or

57          (vi) professional work experience or certifications in the academic field.
58          (10) "Value of the weighted pupil unit" means the amount established each year in the
59     enacted public education budget that is multiplied by the number of weighted pupil units to
60     yield the funding level for the basic state-supported school program.
