8     General Description:
9          This bill creates the Online Dating Fraud Notification Act.
10     Highlighted Provisions:
11          This bill:
12          ▸     requires online dating sites to notify Utah residents if they have interacted with a
13     member who has been banned from the site.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 13-57-101 is enacted to read:

CHAPTER 57. Online Dating Fraud Notification Act

27          13-57-101. Title.

28          This chapter is known as the "Online Dating Fraud Notification Act".
29          Section 2. Section 13-57-102 is enacted to read:
30          13-57-102. Definitions.
31          As used in this chapter:
32          (1) "Banned member" means a member whose account or profile has been removed
33     from the online dating service for violating the policies of the online dating site.
34          (2) "Member" means an individual who submits information to an online dating
35     service to create an account or profile, and who is then granted access to the service.
36          (3) "Online dating service" means a company that primarily provides dating websites
37     or applications for individuals to meet and interact through the use of Internet-connected
38     personal computers or mobile devices.
39          Section 3. Section 13-57-103 is enacted to read:
40          13-57-103. Notifications regarding banned members from an online dating service
41     -- Liability.
42          (1) An online dating service that has banned a member from the dating service that, in
43     the judgment of the online dating service posed a significant risk of perpetuating a financial
44     fraud on other members, shall notify all members who have identified their location as within
45     this state and known to have received and responded to an on-site message from the banned
46     member, of:
47          (a) the user name, identification number, or other profile identifier of the banned
48     member; and
49          (b) a brief description of the reason the member was banned.
50          (2) The notification required by Subsection (1) shall be sent:
51          (a) via email, text message, or other appropriate means of communication; and
52          (b) within 72 hours of the removal of the banned member's account or profile.
53          (3) An online dating service is not liable to any member or individual:
54          (a) for the decision to ban a member or for complying with the provisions of
55     Subsections (1) and (2); or
56          (b) for actions or communications between the banned member and any other member
57     or individual after the notification required by Subsections (1) and (2) is made.
