7     LONG TITLE
8     General Description:
9          This bill amends the Insurance Code regarding governmental immunity.
10     Highlighted Provisions:
11          This bill:
12          ▸     amends provisions of the Insurance Code regarding governmental immunity and
13     arbitration in third party motor vehicle accident cases.

22     Be it enacted by the Legislature of the state of Utah:
23          Section 1. Section 31A-12-107 is amended to read:
24          31A-12-107. Governmental immunity.
25          Notwithstanding any other provision of this title, a governmental entity is not:
26          (1) an insurer for purposes of this title [and is not];
27          (2) engaged in the business of insurance to the extent that it is:
28          [(1)] (a) covering its own liabilities under Title 63G, Chapter 7, Governmental
29     Immunity Act of Utah; or
30          [(2)] (b) engaging in other related risk management activities related to the normal
31     course of its activities[.]; or
32          (3) subject to arbitration under Section 31A-22-321.
