RIGHT TO HUNT AND FISH

8     LONG TITLE
9     General Description:
10          This joint resolution of the Legislature proposes to amend the Utah Constitution to
11     enact language relating to a right to hunt and fish.
12     Highlighted Provisions:
13          This resolution proposes to amend the Utah Constitution to:
14          ▸     enact a provision relating to the individual right of the people to hunt and to fish;
15     and
16          ▸     specify what that right includes and provide limits on the effect of the language
17     articulating the right.
18     Special Clauses:
19          This resolution directs the lieutenant governor to submit this proposal to voters.
20          This resolution provides a contingent effective date of January 1, 2021 for this proposal.

22     ENACTS:
23          ARTICLE I, SECTION 30

25     Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each

26     of the two houses voting in favor thereof:
27          Section 1. It is proposed to enact Utah Constitution Article I, Section 30, to read:
28          Article I, Section 30. [Right to hunt and fish.]
29          (1) The individual right of the people to hunt and to fish is a valued part of the State's
30     heritage and shall be forever preserved for the public good.
31          (2) The right under Subsection (1) includes the right to use traditional methods to hunt
32     and to fish, subject only to statute, and rules and regulations adopted as provided by statute, to:
33          (a) promote wildlife conservation and management;
34          (b) provide reasonable regulation of hunting and fishing activities; and
35          (c) preserve the future of hunting and fishing.
36          (3) Public hunting and fishing shall be the preferred means of managing and
37     controlling wildlife.
38          (4) This section does not affect:
39          (a) the law relating to trespass or property rights; or
40          (b) the State's sovereign authority over the State's natural resources.
41          Section 2. Submittal to voters.
42          The lieutenant governor is directed to submit this proposed amendment to the voters of
43     the state at the next regular general election in the manner provided by law.
44          Section 3. Contingent effective date.
45          If the amendment proposed by this joint resolution is approved by a majority of those
46     voting on it at the next regular general election, the amendment shall take effect on January 1,
47     2021.
